Danny Ayalon: Israel's Right to the 'Disputed' Territories

The recent statements by the European Union's new foreign relations chief Catherine Ashton criticizing Israel have once again brought international attention to Jerusalem and the settlements.

However, little appears to be truly understood about Israel's rights to what are generally called the "occupied territories" but what really are "disputed territories."

That's because the land now known as the West Bank cannot be considered "occupied" in the legal sense of the word as it had not attained recognized sovereignty before Israel's conquest.

Contrary to some beliefs there has never been a Palestinian state, and no other nation has ever established Jerusalem as its capital despite it being under Islamic control for hundreds of years.

The name "West Bank" was first used in 1950 by the Jordanians when they annexed the land to differentiate it from the rest of the country, which is on the east bank of the river Jordan.

The boundaries of this territory were set only one year before during the armistice agreement between Israel and Jordan that ended the war that began in 1948 when five Arab armies invaded the nascent Jewish State.

It was at Jordan's insistence that the 1949 armistice line became not a recognized international border but only a line separating armies. The Armistice Agreement specifically stated: "No provision of this Agreement shall in any way prejudice the rights, claims, and positions of either Party hereto in the peaceful settlement of the Palestine questions, the provisions of this Agreement being dictated exclusively by military considerations." (Italics added.)

This boundary became the famous "Green Line," so named because the military officials during the armistice talks used a green pen to draw the line on the map.

After the Six Day War, when once again Arab armies sought to destroy Israel and the Jewish state subsequently captured the West Bank and other territory, the United Nations sought to create an enduring solution to the conflict.

U.N. Security Council Resolution 242 is probably one of the most misunderstood documents in the international arena. While many, especially the Palestinians, push the idea that the document demands that Israel return everything captured over the Green Line, nothing could be further from the truth. The resolution calls for "peace within secure and recognized boundaries," but nowhere does it mention where those boundaries should be.

It is best to understand the intentions of the drafters of the resolution before considering other interpretations. Eugene V. Rostow, U.S. Undersecretary of State for Political Affairs in 1967 and a drafter of the resolution, stated in 1990: "Security Council Resolution 242 and (subsequent U.N. Security Council Resolution) 338... rest on two principles, Israel may administer the territory until its Arab neighbors make peace; and when peace is made, Israel should withdraw to "secure and recognized borders," which need not be the same as the Armistice Demarcation Lines of 194."

Lord Caradon, the British U.N. Ambassador at the time and the resolution's main drafter who introduced it to the Council, said in 1974 unequivocally that, "It would have been wrong to demand that Israel return to its positions of June 4, 1967, because those positions were undesirable and artificial."

The U.S. ambassador to the U.N. at the time, former Supreme Court Justice Arthur Goldberg, made the issue even clearer when he stated in 1973 that, "the resolution speaks of withdrawal from occupied territories without defining the extent of withdrawal." This would encompass "less than a complete withdrawal of Israeli forces from occupied territory, inasmuch as Israel's prior frontiers had proven to be notably insecure."

Even the Soviet delegate to the U.N., Vasily Kuznetsov, who fought against the final text, conceded that the resolution gave Israel the right to "withdraw its forces only to those lines it considers appropriate."

After the war in 1967, when Jews started returning to their historic heartland in the West Bank, or Judea and Samaria, as the territory had been known around the world for 2,000 years until the Jordanians renamed it, the issue of settlements arose.

However, Rostow found no legal impediment to Jewish settlement in these territories. He maintained that the original British Mandate of Palestine still applies to the West Bank. He said "the Jewish right of settlement in Palestine west of the Jordan River, that is, in Israel, the West Bank, Jerusalem, was made unassailable.

That right has never been terminated and cannot be terminated except by a recognized peace between Israel and its neighbors." There is no internationally binding document pertaining to this territory that has nullified this right of Jewish settlement since.

And yet, there is this perception that Israel is occupying stolen land and that the Palestinians are the only party with national, legal and historic rights to it.

Not only is this morally and factually incorrect, but the more this narrative is being accepted, the less likely the Palestinians feel the need to come to the negotiating table. Statements like those of Lady Ashton's are not only incorrect; they push a negotiated solution further away.

'Fatah officials warn of third Palestinian intifada'

Fatah had made a strategic decision to declare a third intifada against Israel, movement officials told Nazereth-based newspaper Hadith Anas, citing the failed peace talks as the reason for their resolution.

The newspaper report quoted Fatah Central Committee members as saying that the movement wished to implement a decision made during its sixth convention, which assembled last August in the West Bank city of Bethlehem.

One of the movement's top officials interviewed by Hadith Anas said the third intifada will have a widespread popular base, adding, however, that unlike the previous popular struggle against Israel, which was sparked in September 2000, the movement will not endorse an armed struggle or the use of firearms.

"We want thousands of Palestinians to demonstrate daily near the settlements of the occupation, carrying out a human siege, and calling for the end of the occupation," one senior official said.


According to the report, Fatah chief and Palestinian Authority President Mahmoud Abbas agreed to the resolution in principle, stipulating only that the struggle mustn't become a violent one.

Sources estimate that Abbas could prepare the conditions which would allow for such a move by stepping down as PA President as well as by declaring the dissolution of the PA by the end of the year.

Fatah officials had commented recently on the need to duplicate the weekly anti-separation fence rallies in the villages of Na'alin and Bil'in in locations across the West Bank, as well as turning some of those demonstrations against nearby settlements.

A senior member of an Arab-Israeli Knesset party, who maintains close ties with top Fatah and PA officials, said that anti-separation fence rallies could spark renewed popular resistance, if they continued to escalate as they did week ago near the Kalandia checkpoint.

The official said that PA sources have come to understand that unarmed popular resistance, centering on symbols of the West Bank occupation, could garner sympathy for the Palestinian cause in international circles as well as embarrassing the Israeli government.

"The first intifada gained significant diplomatic ground as far as the Palestinians are concerned since its symbol, a boy throwing rocks at a tank, made it impossible for Israel to claim it was defending itself against terror as it did in the second intifada, followings the city-center bombings," the official said.

Anne Frank diary offends Lebanon's Hezbollah

Anne Frank's diary has been censored out of a school textbook in Lebanon following a campaign by the terror group Hezbollah claiming the classic work promotes Zionism.

The row erupted after Hezbollah learned excerpts of "The Diary of Anne Frank" were included in the textbook used by a private English-language school in western Beirut.

Hezbollah's Al-Manar television channel ran a report slamming the book for focusing on the persecution of Jews.

"What is even more dangerous is the dramatic, theatrical way in which the diary is emotionally recounted," said the report aired last week and also published on the station's website.

It questioned how long Lebanon would "remain an open arena for the Zionist invasion of education."

A member of the school board, Jimmy Shoufani, told AFP the school dropped the textbook from its curriculum after the controversy erupted. He asked that the school not be identified.

Hezbollah officials could not reached for comment.
In the Al-Manar report, party MP Hussein Hajj Hassan had criticized the school for showing poor judgment in picking out its textbooks.

"These respected, established schools are teaching the so-called tragedy this girl lived, and yet they are ashamed to teach the tragedy of the Lebanese people, the tragedy of the Palestinian people... the tragedy of the people of the south under the hands of Zionist occupation," he told Al-Manar.

Paris-based organization Aladdin's Project, which fights Holocaust denial and first translated Anne Frank's diary into Arabic, issued a statement condemning Hezbollah's "intimidation campaign."

Hezbollah fought a devastating war with the Jewish state in 2006. It has since refused to surrender its weapons arguing they are necessary to fight Israel, which withdrew from southern Lebanon in 2000.

The militant party last month also took aim at another textbook used in a leading private school in Beirut in which Hezbollah and the Palestinian Islamist group Hamas are referred to as "terrorist organizations".

The chapter in question is usually blanked out by Lebanon's censorship bureau, but an uncensored copy purchased by a student abroad apparently sparked the uproar.

Roots of the Gaza Conflict

With the explosive current events in Gaza, the world needs to understand the roots of this eternal conflict, otherwise we are all kidding ourselves with hopes of peace.

For decades, Arabs had demanded that Israel end the "occupation," and in 2005, Israel did so, disengaging unilaterally from Gaza. With their demands met, there was no ‘cycle of violence’ to respond to, no further justification for anything other than peace and prosperity. With its central location and beautiful beaches on the East Mediteranean, a peaceful and prosperous Gaza could have become another Hong Kong; a shining trade and commerce center. But instead of choosing peace, the Palestinians chose Islamic jihad. They rolled their rocket launchers to the border and started bombing Israeli civilians.

Understanding the reasons why the Palestinians chose violence over peace requires connecting the dots from the behavior of Muslim states back to the laws of Islam: Sharia. Mainstream Sharia books define Jihad as: "to war against non-Muslims to establish the religion." (Shafi’i Sharia o9.0). Jihad is not just the duty of the individual Muslim, but it is also the main duty of the Muslim head of State (the Calipha):


"A Muslim calipha is entrusted to take his people into war and command offensive and aggressive Jihad. He must organize Jihad against any non-Muslim government, which prevents Muslim da’wah (meaning preaching and spreading Islam) from entering its land." (Shafii Law o25.0 to o25.9).

Sharia law# o25.9 states:

"(When the caliph appoints a ruler on a region, his duty includes) if the area has a border adjacent to enemy lands, (he will) undertake Jihad against enemies, dividing the spoils of battle among combatants and setting aside a fifth for deserving recipients."

Also:

"The Caliph makes war upon Jews, Christians and Zoroastrians until they become Muslim or else pay the non-Muslim poll tax provided he has first invited them to enter Islam or pay Jizya, the non-Muslim poll tax, (in accordance with the word of Allah Most High Chapter 9 verse 29)."

Zia-Ul-Haq, former President of Pakistan, said "jihad in terms of warfare is a collective responsibility of the Muslim Ummah."

One of Islam’s eminent 20th century scholars, Sheikh Maolana Maududi said:

"Islam wishes to destroy all states and governments anywhere on the face of the earth which are opposed to the ideology and program of Islam regardless of the country or the nation which rules it. The purpose of Islam is to set up a state on the basis of its own ideology and program … the objective of Islamic jihad is to eliminate the rule of an un-Islamic system and establish instead an Islamic system of state rule. Islam does not intend to confine this revolution to a single state or a few countries; the aim of Islam is to bring about a universal revolution."

Some people seem to think that such laws are just historical relics, on the books but not in practice or in control of the minds of Muslims. But that is the kind of denial we cannot afford; these laws rule the hearts, minds and actions of a majority of Muslim individuals and states around the world today. These scriptures are taught, preached and promoted as the incontrovertible and eternal word of God and funded by Saudi petrodollars throughout the world, including Western nations such as the U.K. and the United States.

No Muslim leader can survive in a Muslim country if he announces the end of Jihad against non-Muslim countries and states that all references to Jihad in Islamic law do not apply today. Treating non-Muslim neighboring countries and individual as equals, with respect and in peace without trying to convert them to Islam, is simply against Islamic Law.

Muslim leaders who dare to go against this theology are called traitors and puppets of the ‘Great Satan’ West. That is a description that no Muslim leader wants to be labeled with. When president Anwar Sadat of Egypt signed the peace treaty with Israel in 1979, he told his confidants that he knew he was signing his own death warrant. He understood that under Sharia he must have permanent war with non-Muslim Israel.

How can a Muslim leader or individual avoid the hundreds of Quran and Hadith commandments to Muslims to kill Jews and Christians? Q 9:29: "Fight those who believe not in Allah until they pay the Jizya with willing submission and feel themselves subdued." Q 9:5: "Slay the unbelievers wherever you find them". Q47.4: "When you encounter the unbelievers, Strike off their heads."

A Muslim leader cannot face his devout Muslim subjects after making a decision to engage in friendship and peace with Jews. Mosques all over the Middle East, after all, recite Mohammed’s commandment to Muslims:

"The Hour [Resurrection] will not take place until the Muslims fight the Jews, and kill them. And the Jews will hide behind the rock and tree, and the rock and tree will say: oh Muslim, oh servant of Allah, this is a Jew behind me, come and kill him!" (Sahih Muslim 41:6985, also Sahih Bukhari 4:52:177)

This Hadith, issued by Mohammad, makes a whole group of people illegal to exist. It was issued in the 7th century, not after the 1948 creation of the State of Israel. It is not a response to modern-day grievances; it is a permanent commandment.

Many Muslims claim that Arabs and Jews lived well together for many years before 1948. But that claim ignores the fact that Jews had to live as ‘dhimmies’ under Islamic Law and were never allowed to rule themselves separate of the Islamic Sharia. When Muslims were weak they often treated their dhimmi subjects well and ignored the commandments to kill, subjugate and humiliate them. But Jew hatred is intrinsic to Islamic scriptures that do not permit reformation under the penalty of death.

This is the real basis of the Arab/Israeli conflict: not a conflict over land or occupation, but a divine obligation to destroy neighboring (non-Muslim) Israel, where Jews are no longer dhimmis but are free to rule themselves. We cannot ignore the root of the problem in Muslim scriptures. That is the true force behind the hate and propaganda Jihadist machine against Jews in the Muslim world.

Some Muslims tell me that they don’t believe in Sharia and question why am I making a big deal about it. My answer is that Sharia is the law of the land in 54 Muslim countries and many Muslim groups are demanding Sharia in the West. In 1990, 45 Muslim countries signed the Cairo Human Rights Declaration which stated that Sharia has supremacy over the UN Universal Declaration of Human Rights.

The Muslim world must look within to its sacred laws, scriptures, sermons, teaching and preaching, and reform the obstacles for peace that have condemned them to a permanent state of jihad. The non-Muslim world must have no illusions.

Where is a soapbox when you need one?

Israel
I don't want to get off on a rant here.

I don't want to philosophize nor pontificate or preach from the moral high ground............... BUT!

After surfing the net for the last few hours I have come across hundreds of sites and blogs and stories of protest marches condemning Israel for what some are calling "aggression" and most Arabs are calling "occupation."

That's all fine and dandy since I believe that freedom of expression is a basic right that should not be taken away.............. BUT!

How come I have not seen one little bitty site or heard of one little bitty protest group that is marching against Hamas for bombing Israel the last few months and starting all this shit?

Would someone please tell me!

How come?

No, really, how come?

(Let's get things back into "Perspective" here!)
