CAIR concedes it doesn't legally exist

The Council on American-Islamic Relations' latest legal brief in its "Muslim Mafia" lawsuit provides no evidence it suffered damages and effectively concedes it filed the complaint under a false name, concludes a lawyer defending a father-and-son team that conducted an undercover probe to document the Muslim group's ties to terrorism.

CAIR's reply to a motion to dismiss its lawsuit against former Air Force special agent P. David Gaubatz and his son Chris, who served a six-month CAIR internship posing as a young Muslim convert, "concedes that they don't have any legal damages, but they hope they'll find some," said attorney Daniel Horowitz, who filed the motion to dismiss in December.

CAIR alleges the Gaubatzes obtained access to the Muslim group's property under false pretenses, removed internal documents and made recordings of officials and employees "without any consent or authorization and in violation of his contractual, fiduciary and other legal obligations to CAIR."

However, asserted Horowitz, CAIR is on a "fishing expedition," filing a lawsuit with the hope that "after the expenditure of unknown amounts of money and time, it might find some damages."

"If CAIR is conceding that they have no interests that prevent the materials from being disclosed, what is their excuse for trying to suppress the book?" Horowitz asked. "It's about time the American public put an end to these legal abuses by CAIR."

In his motion to dismiss, Horowitz argued that CAIR is unable to demonstrate it suffered harm and, furthermore, has no claim because the group does not legally exist. Horowitz explains that CAIR changed its name to the Council on American-Islamic Relations Action Network almost immediately after it was named by the Justice Department as an unindicted co-conspirator in the largest terror-finance case in U.S. history.

As WND reported yesterday, the Gaubatzes' legal counsel, in compliance with a subpoena served by the FBI, turned over to federal authorities 12,000 of pages of internal CAIR documents obtained in the undercover probe that allegedly confirm the D.C.-based Muslim group's role as a front for terrorist groups that seek Islam's domination over the U.S.

The documents provided key material for the book "Muslim Mafia," co-authored by David Gaubatz and "Infiltration" author Paul Sperry. The authors assert CAIR is acting as a front for a conspiracy of the Muslim Brotherhood – the parent of al-Qaida and Hamas – to infiltrate the U.S. and establish Saudi-style Islamic law.

Horowitz contends CAIR's reply does not address his allegation that the group used a non-existent entity to file the lawsuit, "dismissing the use of the wrong name by calling it a 'misnomer.'"

"This is not like confusing the name 'Dan' with 'Don' or 'Tim' with 'Tom'," Horowitz said.

"CAIR forms groups, dissolves them, takes credit for them or disclaims them as it sees fit," he said.

The legal name change in May 2007 to Council on American-Islamic Relations Action Network, for example, came just two weeks after the Justice Department's designation of CAIR as an unindicted co-conspirator in the prosecution of the Holy Land Foundation. The Texas-based group was convicted of channeling funds to the Palestinian terrorist group Hamas.

Horowitz points out that when he defended Michael Savage in CAIR's case against the radio talk host, CAIR's own attorneys appeared separately for CAIR and for CAIR Action Network, or CAIR-AN.

"CAIR and CAIR-AN are two distinct corporate entities," he said, "and while CAIR-AN may be a successor to CAIR, the name problem goes far deeper than mistakenly using a predecessor corporation."

'Negative light'

In its legal reply to Horowitz, CAIR concedes it cannot sue over First Amendment-protected activities such as publishing information about the organization.

But Horowitz argues that CAIR, nevertheless, focuses its entire complaint "on the attacks on its self-proclaimed character as a civil rights organization."

CAIR, he points out, says Chris Gaubatz' mission was both to collect and to "misappropriate information" that was "to later be disclosed publicly and used to cast CAIR in a negative light."

Those actions, CAIR claims, "caused CAIR and its officials and employees to suffer unwarranted harassment up to and including threats of violence."

But Horowitz argues that in CAIR's legal briefs, "no specific threats are alleged and no attempt is made to show that the alleged wrongful conduct had any relation to the alleged threats."

He also points out CAIR's original pleading does not make it clear that the documents taken from CAIR were consigned to the shredder.

CAIR says in its reply brief that much of "Muslim Mafia" is "devoted to critiquing CAIR" and, contrary to the defendants' claims, is "a decidedly unserious book that only warrants CAIR's attention due to the criminal and tortious conduct which it admits Defendants perpetrated upon CAIR."

Horowitz calls that statement another concession by CAIR that it suffered no damages.

"If all that warrants 'CAIR's attention' is the alleged 'criminal and tortious conduct,' there is simply no federal jurisdiction," he contends.

Horowitz calls CAIR's complaint "an impermissible end run around First Amendment protections."

"The fact that 'CAIR' is upset or that members may have been threatened does not weaken the First Amendment protections," Horowitz argues.

CAIR's claim of breach of fiduciary duty and breach of contract is based on its allegation thath Chris Gaubatz signed a confidentiality agreement when he began his internship. But CAIR has not been able to produce evidence any agreement was ever signed, and Horowitz says that even if signed, "this document would have been signed between a non-existent corporate entity and Chris Gaubatz. There need to be two parties to a contract."

With the FBI cutting off ties to the Council on American-Islamic Relations and now subpoenaing some 12,000 internal CAIR documents under temporary restraining order as part of the bureau’s ongoing criminal investigation of CAIR, the terrorist front group is suddenly cooperating with the FBI — or at least making a show of it.

Suddenly CAIR, an unindicted terrorist co-conspirator, is acting like a good citizen.

Suddenly it’s concerned about young Muslim-American men going on jihad. Suddenly it’s concerned about “certain” passages of the Quran inspiring jihadists.

It’s all too little, too late.

Thanks to CAIR, 42 brave American soldiers were gunned down by an Islamic nut in Texas. That’s right, thanks to CAIR.

How so? For starters, it was the intimidating and ruthless CAIR that almost single-handedly created a climate of fear of reporting any suspicious anti-American behavior on the part of Muslim soldiers like Army Maj. Nidal Malik Hasan, accused of the worst terrorist attack on U.S. soil since 9/11.

The CAIR-induced mass silence led to mass murder.

Fear in the military of being seen as anti-Muslim also blocked intellectually honest discussion of violent Islamic ideology in the ranks.

Thanks to CAIR, the military along with everyone else in government is terrified of associating terrorism with Islam. No one dares utter the M word, lest they be sued for discrimination or branded an “anti-Muslim bigot” or “Islamophobe” by CAIR’s smear merchants.

“There were definitely clear indications that Hasan’s loyalties were not with America,” said Lt. Col. Val Finnell, one of the Army doctors who served with Hasan. But nobody said anything because “there’s a political correctness climate in the military,” and everybody’s “afraid of an equal opportunity lawsuit.”

CAIR’s lawyers have filed thousands of EEOC complaints and lawsuits since 9/11. They’ve even gone after John Doe citizens who alerted airline crew to Muslim men behaving as menacingly and suspiciously as the 9/11 hijackers. CAIR’s “Flying While Muslim” anti-profiling campaign has had a chilling effect throughout the aviation security industry.

CAIR gulled non-Muslims into the kind of see-no-evil dhimmitude that allowed Hasan to carry out his alleged terror. Had anyone dared officially protest Hasan’s extremist views, they would have not only risked their military careers but potentially faced a lawsuit sponsored by CAIR.

Hasan was treated with kid gloves because CAIR demanded it.

Thanks to CAIR, a dozen soldiers lay dead, along with 29 wounded, some so severely they’ll never be deployed in the war on terror again, which is just fine by CAIR.

Since 9/11, the Saudi-funded front group has consistently and vehemently protested the war, even in Afghanistan, while defending the Taliban and other terrorists.

The internal threat from Muslim extremists in the military extends to high-level Defense Department aides who have undermined military policy. In fact, one top Muslim adviser pushed out an intelligence analyst who warned of the sudden jihad syndrome that led to the Fort Hood terrorist attack.

An honored guest of the Ramadan dinner at the Pentagon this September was Hesham Islam, who infiltrated the highest echelons of the Ring despite proven ties to U.S. terror front groups and a shady past in his native Egypt.

As senior adviser for international affairs to former deputy Defense Secretary Gordon England, Islam ran interference for the Islamic Society of North America and other radical fronts for the Egypt-based Muslim Brotherhood, the subject of my new book "Muslim Mafia."

For example, Islam persuaded brass to sack a Pentagon analyst, Stephen Coughlin, after he advised cutting off outreach to ISNA, which he accurately ID'd as part of a covert terror-support network in the U.S. — something the Justice Department recently confirmed in a major terror finance trial.

Islam invited ISNA officials to lunch with the avuncular England, known by insiders as Gullible Gordon, who in turn spoke at ISNA confabs. Islam also helped set up a Pentagon job booth at one recent ISNA convention to recruit Muslim chaplains and linguists.

Most disturbing, Islam met regularly with Saudi and other embassy officials lobbying for the release and repatriation of their citizens held at Gitmo. He in turn advised England, who authorized the release of dozens of Gitmo detainees. Some have resumed terrorist activities.

No one really knew who Islam was when he was promoted — in fact, the Pentagon removed his bio from its Web site after reporters noted major inconsistencies in it — yet he was allowed to get inside the office of the Pentagon's No. 2 official.

"In effect," a senior U.S. Army intelligence official told me, "we've got terrorist supporters calling the shots on our policies toward Muslims from the highest levels."

Meanwhile, politically incorrect prophets like Coughlin have been frozen out. After the betrayal at Fort Hood, the military could use his analysis of Islamic doctrine more than ever.

I attended a private briefing by Coughlin in February. In a PowerPoint presentation, he detailed how jihadists use the Quran to justify their actions. Some of his slides matched almost word-for-word Hasan's own PowerPoint slides extolling the virtues of jihad and martyrdom. Both, for instance, quoted from the same Quranic passage known as the "Verse of the Sword."

Eerily, Coughlin predicted Hasan's mind-set. He first began briefing the Pentagon on this jihadist doctrine in 2002. So brass can't say they didn't know.

They were warned that the enemy was drawing on religious principles, and that our own Muslim soldiers could succumb to such thinking.

And they were warned that by using ISNA and other radical Brotherhood fronts to endorse Muslim chaplains and recruit Muslim soldiers, they were courting enemies of the U.S. — and courting disaster. But they were too drunk with political correctness to listen.

The jihadist threat to U.S.-based armed forces is external as well as internal — and far greater than reported. It comes from both inside and outside the military.

Fort Hood follows in a line of attacks or plots against military personnel and installations since 2006, when al-Qaida spokesman Adam Gadahn, an American convert to Islam, appeared in a video with Osama bin Laden and encouraged fellow Muslim-Americans to "go on a shooting spree at the Marines' housing facilities at Camp Pendleton" in California.

Over the past few years, an alarming number of homegrown Muslim terrorists have targeted military installations, including:

• A North Carolina cell of white converts to Islam who trained to attack Marine headquarters in Quantico, Va.

• A New York cell of black jailhouse converts who planned to down planes at an Air National Guard base with shoulder-fired missiles.

• A lone Muslim convert who shot two soldiers at a Little Rock, Ark., Army recruiting station, killing one.

• A Los Angeles cell of black Muslim converts who plotted to hit military bases in California.

• A New Jersey cell of hardened jihadists who trained to attack Fort Dix by posing as pizza delivery drivers.

The Fort Dix terrorists had also talked about joining the U.S. Army so they could kill U.S soldiers from the "inside." They planned to hit the post just days after a National Guard unit arrived back from Gitmo. Some of them were inspired by al-Qaida preacher Anwar Awlaki, who on his Yemen-based Web site calls for jihad against U.S. military targets inside and outside the U.S.

But so do so-called moderate American clerics like Zaid Shakir. In "Muslim Mafia," I transcribe for readers a CD recording of one of his sermons circulating in mosques across America. In it, he exhorts the Muslim faithful to attack planes carrying the 82nd Airborne.

Frequently booked by the Council on American-Islamic Relations (CAIR) as a guest speaker at its events, Shakir tells his Muslim audience: "Jihad is physically fighting the enemies of Islam to protect and advance the religion of Islam. This is jihad."

Acceptable targets of jihad, he says, include U.S. military aircraft. "Islam doesn't permit us to hijack airplanes filled with civilian people," he said, but "if you hijack an airplane filled with the 82nd Airborne, that's something else."

The 82nd Airborne is based out of Fort Bragg, which is part of North Carolina state Sen. Larry Shaw's home district. Shaw is CAIR's new chairman. He is also a minority contractor who operates Shaw Food Services Co. near Fort Bragg. According to the legislator's financial disclosure form, Shaw Food customers include the Defense Department.

Yet CAIR, like ISNA, is an unindicted terrorist co-conspirator. The FBI says CAIR is a terrorist front group and has cut off formal ties to it. So should the military.

Will Fort Bragg be next? Does anybody care?

This enemy is hiding behind a religion, making it easier for them to infiltrate our sensitive security agencies.

Communist spooks did not have such an advantage.

Paul Sperry: Homegrown Insurgency

You’ve heard the narrative from the Beltway punditry: Our Muslims are better assimilated than Muslims in Europe. Our Muslims are more Westernized, less radicalized.

Well, it’s a false narrative.

We are seeing the horns of a Muslim insurgency in this country. We are being Europeanized. And we need a counterinsurgency plan not just in Afghanistan but right here at home.

While our leaders are too politically correct to even think about such a thing, they are starting to at least recognize the problem.

Even President Obama, who still won’t utter the M word, notes the rise in “extremists within our borders.” So does his Homeland Security chief, who just months earlier fixated on white militia groups as the main domestic terror threat.

“We are seeing young Americans who are inspired by al-Qaida and radical ideology,” echoed DHS secretary Janet Napolitano, while still failing to name the source of that ideology. “Home-based terrorism is here.”

And for the first time, a senior Justice Department official has gone on record saying the U.S. is turning into Europe, with Muslim citizens becoming more and more hostile toward the government, and plotting and carrying out more acts of homegrown terrorism.

“If there was ever a subconscious belief in the counterterrorism community that our society is different from Europe and therefore we don’t have to worry about problems like they’ve had, the activities in Minneapolis demonstrate we can’t think that way,” said Patrick Rowan, who led Justice’s national-security division when the government first started investigating the case of the 20 young Somali-American men who quit college and gave up promising careers in Minneapolis to join al-Qaida’s jihad in Somalia.

The FBI fears the recruits — who have U.S. passports — may use their terror training to come back and attack their own country. One of them already carried out a suicide bombing, becoming the first American to do so.

“We should all be on guard,” said Ralph Boelter who heads the FBI’s Minneapolis field office.

As we dig in deeper in Afghanistan, hostility among our own Muslim population will only grow deeper. And as we import more refugees from Muslim countries, demands for Shariah (think: Taliban) law will only grow shriller. Consider that:

* A new Gallup poll finds American Muslims are most likely to report feeling anger compared with the overall population — making even more of them ripe for radicalization.

FP: David Gaubatz, welcome to Frontpage Interview. Congrats on your book, Muslim Mafia.

I would like to talk to you today about how CAIR and other Islamic organizations deceive the public.

But first, give us some updates on your work and what is going on.

Gaubatz: Thank you Jamie. I owe thanks to the WND staff at all levels, to Paul Sperry (co-author), and to all of the researchers who worked on this CAIR project. Without them, the book would not exist.

On Dec. 1, 2009, I was asked to speak at the National Security Roundtable, hosted by Ronni Shalit, in NY. The trip to NY was a pleasure and it was an honor to speak to such a well informed group of people. The group consisted of people from many professions, including law enforcement, attorneys, bankers, and many more.

What I am beginning to see is that Americans are becoming more informed of national security issues and they are no longer simply sitting back and expecting our elected officials to insure our nation is secured. Americans are beginning to insist that our nation be secured.

We have a very, very valuable commodity in our country, as does every country: our children.

It is apparent Americans are no longer going to rely on elected officials (many who wittingly and some unwittingly) who support the interests of Islamic based terrorist organizations more than they do our troops and our country.

The message to politicians who support terrorist groups either from being uninformed, naïve, incompetent, or intentionally (like Congressman Keith Ellison (MN) and Senator Larry Shaw (NC) is either do your job (protect our children from Islamic based terrorism) or leave office. You are no longer wanted.

FP: What do you think, is the state of New York better protected than before Sept. 11, 2001?

Gaubatz: For a few months after the murder of thousands of people by Islamic terrorists, the people of NY came together. Unfortunately it did not take long before many forgot what happened in their city, what is happening to our troops in Afghanistan and Iraq, and what has been happening (terrorist attacks) to the people of Israel for many years.

Many have again fallen into the trap of a false sense of security. Anytime a city or state allows people to openly declare they are seeking the destruction of our country and are calling for violence against innocent Christians and Jews in their theological texts, no location is safe.

I am not an attorney, but as an American I do not believe our U.S. Constitution was designed for allowing treason, sedition, and calling for killing our citizens. Our Constitution was designed to protect our country.

FP: How can our law enforcement effectively and timely protect our country from future attacks?

Gaubatz: We have a long educational process of our law enforcement and politicians ahead of us. This has to happen before we can truly realize any steps forward in protecting our country. Few understand Sharia law (Islamic law) and they can’t rely on organizations such as CAIR, ISNA, MSA, and the host of other terror supporters to explain to them what Sharia law actually means in regards to the protection of our country.

Investigative journalism reaches new levels in doughtiness and concludes with a shocking crescendo in this tome, as Gaubatz, his son Chris and Paul Sperry infiltrate the shady Washington, DC based organization known as the Council on American-Islamic Relations (CAIR); the nation's largest and purportedly mainstream Muslim-American "civil rights" advocacy agency. The frightening facts published in this book are supported by more than 12,000 pages of confidential CAIR documents and hundreds of hours of video captured in this unprecedented undercover operation.

Through painstaking and nuanced research of internal memos and documents the authors establish the fact that CAIR is the ideological cousin of the notorious Muslim Brotherhood and their leadership is inextricably tied to the promulgation of an explosively violent "jihadist" agenda. This book could effortlessly take it's rightful place among classic hair raising espionage thrillers if it's tragic geo-political realities weren't so terrifying. The authors scrupulously document CAIR's foreign fundraising sources including exceedingly large donations from the Wahabi dominated Saudi Arabian government that gave birth to the 9/11 hijackers. Not to be outdone, CAIR also assumes the role of benefactor, as the recipients of their financial largesse include such heinous terror organizations as Hamas.

Moreover, the authors offer shocking revelations about CAIR's infiltration of key US law enforcement agencies including local police departments, the FBI, the CIA and the State Department as well as their heavy handed influence operations against members of homeland security committess on Capitol Hill and their insertion of Islamic spies in congressional offices. According to the authors, FBI wiretaps reveal that, "During a secret Muslim Brotherhood meeting he organized last decade, CAIR founder and former chair Omar Ahmad expressed the need to strengthen "the influence with Congress." He argued for using Muslims as an "entry point" to "pressure Congress and the decision makers in America" to change US foreign policy in the Middle East and other policies."

CAIR's far reaching tentacles have even permeated corporate America, say the authors, as they and their sister organization, the Islamic Society of North America blackmail Wall Street firms who do not comply with Islamic financing principles. The authors also spotlight CAIR's use of intimidation tactics in silencing their political opponents as evidenced in their efforts to unleash a vitriolic campaign to blacklist such media personalities as Bill O'Reilly, Dr. Laura Schlesinger, Glenn Beck and Michael Savage while pressuring the National Review to acquiesce to their demands.

While elected officials from both sides of the aisle, including former president George W. Bush, have legitimized the dubious organization with governmental recognition and ceremonial gravitas, CAIR's underlying credo remains seditious and rabidly anti-American until this very day. The authors remind us that in the aftermath of the 9/11 attacks, President Bush appeared alongside officials from CAIR and other outwardly benign Muslim groups that weren't properly vetted at the Islamic Center of Washington in a display of "unity". The unsuspecting former president announced, "It is my honor to be meeting with leaders who feel just the same way as I do. They're outraged, they're sad. They love America just as much as I do." These words would come back to haunt the president as facts concerning CAIR's zealous legal representation of Muslim Americans charged with terrorist activities came to the fore and as history would record, certain members of CAIR's own leadership would turn out to be unindicted co-conspirators in helping to finance terrorist organizations.

As the burgeoning and pernicious scourge of global radical Islam continues to proliferate in an unfettered manner, it is clear that within our borders the threat to our cherished democratic values and principles are all too real. The release of this book of paramount importance by authors Gaubatz and Sperry hasn't come a moment too soon. To say that the information published in these pages is a real eye opener is an understatement of monumental proportions. It is a must read for anyone, the world over, who still clings to the hope of freedom, peace and liberty that Western civilization represents.

CAIR speaker to Muslims: OK to attack Fort Bragg

A Council on American-Islamic Relations adviser and regular speaker at its events has suggested Islamic law permits Muslims to attack C-130 military transport planes carrying the 82nd Airborne out of Fort Bragg, N.C., according to a stunning new book exposing Washington-based CAIR's inner workings.

Radical Islamic cleric Zaid Shakir, a frequent guest speaker at CAIR events, tells his Muslim audiences:

"Jihad is physically fighting the enemies of Islam to protect and advance the religion of Islam. This is jihad."

The recording of the lecture, which Shakir gave earlier this decade to a Muslim audience in the San Francisco Bay area, was obtained by the authors of the bestselling "Muslim Mafia: Inside the Secret Underworld That's Conspiring to Islamize America."

The bombshell revelation comes in the wake of the worst military massacre at a domestic U.S. military base in American history, and the worst Islamic terrorist attack on U.S. soil since 9/11.

Last week, Army Maj. Nidal Malik Hasan allegedly gunned down in cold blood more than 50 of his fellow soldiers preparing to deploy to Iraq and Afghanistan from Fort Hood, Texas.

Eyewitnesses say before opening fire, Hasan jumped up on a desk and screamed, "Allahu akbar!" like the 9/11 hijackers. The suspect fatally shot 13, including a security guard. The death toll is actually 14 when a slain unborn child is counted.

Imam Shakir also gives his blessing to the use of bombs as a weapon of jihad, as long as the explosives hit "select" targets and are not indiscriminate in their destruction.

Civilians can be a legitimate target, he says, if "there's a benefit in that," according to "Muslim Mafia," co-authored by former federal agent P. David Gaubatz and investigative journalist Paul Sperry, author of "Infiltration."

Even "old elderly men" and "women who are conscripted" – including Israeli and American women in uniform – are eligible enemy combatants in jihad.

"This is Shariah," Shakir asserts in a CD recording of one of his lectures in 2001, which the authors obtained from a radical mosque bookstore in Brooklyn, N.Y.

A terrible tragedy occurred yesterday at Ft. Hood, Texas. Because you are the co-author (with Paul Sperry) of the new book Muslim Mafia, I would like to ask you this: are there any correlations between your message in the book about the ideology of the Muslim Brotherhood and the murder spree at Ft. Hood?

Gaubatz: Thanks Jamie.

Yes. The murders by Malik Nadal Hasan at Ft. Hood, TX are not a ‘lone wolf incident’ as being described by most media organizations.

Hasan had been taught the ideology that is being advocated by hundreds of Islamic scholars and Imams in the U.S.

We as a country can continue to deny there are numerous Islamic leaders and their supporting organizations such as CAIR, ISNA, MSA, and MANA, to name a few, who advocate killing innocent men, women, and children whom they allege ‘oppress Islam.’

How many more incidents similar to this that have been occurring in America does it take before even the media wants to report the truth?

Politicians will always say or do whatever will get them their next vote in an upcoming election, but there was a time in our history when journalists reported everything and were not concerned with ‘political correctness.’

This type of journalistic reporting is dangerous and in itself is a national security issue.

Journalists and their affiliated news organization are so afraid of being labeled or sued by organizations such as CAIR that they will withhold the truth from the American people. In part, the murders of innocent people are partly the fault of such journalists and politicians who support organizations such as CAIR.

FP: Your thoughts on CAIR and what happened at Ft. Hood?

Gaubatz: My team and I have conducted first-hand research at over 200 Islamic Centers in the U.S., and in various Islamic organizations such as CAIR.

There is one common denominator: There is an open hatred being advocated by Islamic scholars toward Christians, Jews, and Muslims who do not adhere to ‘all aspects’ of Sharia law (Islamic law).

CAIR files suit against 'Muslim Mafia' author

The Council on American-Islamic Relations has filed a federal lawsuit against a co-author of the newly released book "Muslim Mafia" and his son, charging they conspired to carry out a six-month undercover operation in which they secretly recorded meetings and stole thousands of pages of sensitive documents from the Washington, D.C.-based Muslim group.

In the book, "Muslim Mafia: Inside the Secret Underworld That's Conspiring to Islamize America," published by WND Books, P. David Gaubatz and "Infiltration" author Paul Sperry present first-hand evidence CAIR is acting as a front for a well-funded conspiracy of the Muslim Brotherhood – the parent of al-Qaida and Hamas – to infiltrate the American system and help pave the way for Saudi-style Islamic law to rule the U.S.

In the lawsuit, however, CAIR, which describes itself as a Muslim civil-rights group, does not defend itself against the book's claims.

U.S. District Judge Colleen Kollar-Kotelly ordered P. David Gaubatz and his son, Chris Gaubatz, to appear in her District of Columbia court today to respond to CAIR's demand for a restraining order.

CAIR says it seeks to prevent any further disclosure or distribution of the 12,000 pages of documents Chris Gaubatz acquired from the group while working as an intern under the pseudonym David Marshall.

The two defendants did not appear in court. Dave Gaubatz told WND he had not seen the complaint and had not been served with a subpoena.

The complaint says CAIR is seeking punitive damages for trespass, breach of contract, conversion and breach of fiduciary duty.

The FBI cut off ties to CAIR in January after the group was named an unindicted co-conspirator in the Holy Land Foundation case in Texas, the largest terrorism-finance case in U.S. history. Democratic Sen. Charles Schumer of New York and other senators have called for a government-wide ban on CAIR.

CAIR's lawsuit alleges Chris Gaubatz obtained access to CAIR property under false pretenses and removed the internal documents and made recordings of officials and employees "without any consent or authorization and in violation of his contractual, fiduciary and other legal obligations to CAIR."

Dave Gaubatz told WND the "research project pertaining to CAIR was conducted in a professional and legal manner."

He said it was "funded by a high profile U.S. organization with very close ties to senior law enforcement and U.S. government officials."

Gaubatz said he cannot name the group now, but noted it is not SANE, the Society of Americans for National Existence, as widely believed.

"This organization is very professional, and every step of the research was coordinated with their legal team and senior personnel," he said. "From the very onset of the research, our researchers observed intelligence in CAIR documents which appeared to be national security concerns." Read more here ...

Book: CAIR chief gave thousands to cop-killing jihad cell leader

Already under increased scrutiny after revelations in a new book, the Council on American-Islamic Relations now is defending itself against documented links to a federal case that drew national attention this week when an indicted Detroit imam was killed in an FBI raid.

Internal documents from an undercover investigation by the authors of "Muslim Mafia" show CAIR helped finance the legal appeal of Muslim cop-killer Jamil Abdullah Al-Amin, who is named in the Detroit criminal complaint as the spiritual leader of a radical group that calls for violent action to establish a sovereign Islamic state within the U.S.

The federal complaint also states one of the 11 indicted followers of the imam who was killed in an exchange of gunfire with the FBI Wednesday, Luqman Ameen Abdullah, attended a mosque "affiliated with CAIR" in Windsor, Ontario, just across the Canadian border from Detroit.

The criminal complaint suggests CAIR literature supporting Al-Amin incited Abdullah to violence.

"CAIR and everybody send me all of this stuff. I get sick," he was recorded as saying. "I got some soldiers with me. ... Brothers that I know would, you know, if I say 'Let's go, we going to go and do something.'"

Abdullah and his "soldiers" trained with weapons and explosives to carry out a plot to "take down" the U.S. government in violent jihad, according to the complaint.

Al-Amin, the complaint adds, has been designated by the "nationwide radical fundamentalist Sunni group" led by Abdullah to be the ruler of the future Islamic state.

Formerly a leader of the Black Panther Party known as H. Rap Brown, Al-Amin is serving a life sentence at the Florence, Colo., Supermax prison for shooting two police officers in Georgia and murdering one of them.

As revealed in a confidential letter obtained by the authors of "Muslim Mafia," P. David Gaubatz and Paul Sperry, CAIR made an "additional contribution" of $9,000 in April 2007 to Al-Amin's legal appeal.

The letter of thanks addressed by the cop-killer's lawyer-wife to CAIR Executive Director Nihad Awad, which indicated CAIR had made previous contributions, passed on "greetings" from the imprisoned imam.

Al-Amin, a black convert to Islam, shot two Atlanta deputies in 2000 who were trying to arrest him for failing to appear before a judge on auto theft charges. One deputy was shot in both legs, the left arm and the chest.

The other, Fulton County Deputy Ricky Kinchen, died after Al-Amin pumped him with six bullets. A jury convicted Al-Amin in 2002 and sentenced him to life in prison, but CAIR jumped to his defense, celebrating him as a martyr.

Coverage of lawmakers' charges ignores terror ties

Is the Council on American-Islamic Relations merely a civil rights organization exercising its constitutional right to lobby on Capitol Hill like hundreds of other non-profit organizations?

That's the way Politico and other mainstream news outlets have portrayed CAIR – despite the FBI's decision this year to cut off ties to the Muslim group after its designation by the Department of Justice as an "unindicted co-conspirator" in the largest terrorist-finance case in U.S. history.

In its coverage of a press conference on Capitol Hill in which four Republican House members presented an internal CAIR document revealed in the new WND Books release "Muslim Mafia" that shows the group sought to place interns in the intelligence, homeland security and judiciary committees, Politico characterized the document as a "fairly straightforward public relations and lobbying strategy."

There was no mention of the undisputed fact that along with CAIR's designation as an unindicted co-conspirator in the Texas-based Holy Land Foundation, many of its leaders and prominent supporters have been convicted in terrorism-related cases.

FBI officials have testified CAIR's parent group, the Islamic Association for Palestine, was founded as a front group for the Palestinian terrorist group Hamas. And evidence from the FBI presented at the Holy Land trial showed CAIR Executive Director Nihad Awad and founder Omar Awad participated in a three-day summit in 1993 of U.S.-based Hamas members and supporters.

Wiretaps revealed Ahmad argued for using Muslims as an "entry point" to "pressure Congress and the decision makers in America" to change U.S. foreign policy in the Middle East.

Democratic Sen. Charles Schumer of New York – who has described CAIR as an organization "which we know has ties to terrorism" – formally supported the FBI's divorce with CAIR in a letter to the agency's director signed with Sens. Jon Kyl, R-Ariz., and Tom Coburn, R-Okla.

In 2007, Democratic Sen. Barbara Boxer of California withdrew an award to the head of CAIR's Sacramento chapter, citing "concerns" about the group's associations. She explained her office had not thoroughly researched CAIR.

Internal e-mails, according to "Muslim Mafia," show CAIR debated going "all out against" Boxer in a smear campaign but decided against it because she's a popular Democrat, and CAIR didn't think it could make an attack "hurt her enough."

D.C. Muslim group's shocking al-Qaida ties

CAIR's terror connections extend beyond Hamas to Enemy No. 1

The Washington-based Council on American-Islamic Relations' ties to terrorism are not limited to Hamas and cross over to al-Qaida, America's No. 1 enemy, a top-selling new book alleges.

In just one of several shocking and previously unreported findings, "Muslim Mafia: Inside the Secret Underworld That's Conspiring to Islamize America" details a secret meeting between CAIR's founding chairman and al-Qaida's spiritual leader in America – blind Sheik Omar Abdul-Rahman – who is now a convicted terrorist. Al-Qaida's top leaders have vowed revenge for the federal imprisonment of the Egyptian-born cleric.

CAIR has come under fire in the past for supporting the Blind Sheik, who was convicted in the 1993 World Trade Center bombing investigation. But the group maintains "this is a lie. No evidence substantiating this falsehood has ever been offered."

However, "Muslim Mafia" – co-authored by former federal agent P. David Gaubatz and investigative journalist Paul Sperry – reveals that around the time the Blind Sheik was plotting to bomb major New York landmarks, he traveled from New York to San Jose, Calif., to meet privately with Omar M. Ahmad, CAIR's long-time chairman, who is now under active federal investigation.

The CAIR leader allegedly hosted the senior al-Qaida figure and his phalanx of bodyguards at his home, according to the book. Just a few years later, the Blind Sheik's longtime Egyptian friend Ayman al-Zawahiri, now second in command of al-Qaida, showed up at a San Jose mosque led by Ahmad and other Muslim Brotherhood figures. The mosque hosted a fundraiser for him.

Ahmad, aka Omar Yehia, this year abruptly stepped down from CAIR's national board after U.S. prosecutors named him an unindicted co-conspirator in a criminal plot led by the Holy Land Foundation charity to underwrite Palestinian terrorism. The trial, which ended in convictions on all 108 felony counts, marked the largest terror-financing case in U.S. history.

"During that trial," assistant FBI Director Richard C. Powers this April wrote in a letter to the Senate Judiciary Committee, "evidence was introduced that demonstrated a relationship among CAIR, individual CAIR founders (including its current President Emeritus and its Executive Director) and ... HAMAS, which was designated as a terrorist organization in 1995."

Jesse "Shakedown" Jackson to headline CAIR banquet next week

The Council on American-Islamic Relations (CAIR) announced on Friday that none other than Jesse "Shakedown" Jackson will be headlining their annual banquet next Saturday.

He will be sharing the stage with 1993 World Trade Center bombing unindicted co-conspirator Siraj Wahhaj.

It would sure be unfortunate if Shakedown Jesse and his CAIR conspirators were met with some kind of protest outside the Marriott Crystal Gateway in Arlington, Virginia next Saturday, October 24th at 7pm where the banquet is being held (just a block away from the Crystal City Metro Station):

No doubt CAIR put down considerable cash to bring Shakedown Jesse to town after four members of Congress demanded an investigation this week in response to the release of a new explosive expose, Muslim Mafia, by Dave Gaubatz and Paul Sperry. No doubt that's what prompted Obama Muslim adviser Dalia Mogahed (who we reported on last week) to back out of the banquet at the last minute.

As Daniel Pipes explains, this new book is based on 12,000 internal CAIR documents secretly obtained through an undercover investigation and destroys the prevailing myths about the Hamas front group, which was itself and its founders named unindicted co-conspirators in the Holy Land Foundation terrorism finance trial last year (continued below the fold):

Claim 1: According to Ibrahim Hooper, the organization's communications director, "CAIR has some 50,000 members." Fact: An internal memo prepared in June 2007 for a staff meeting reports that the organization had precisely 5,133 members, about one-tenth Hooper's exaggerated number.

Claim 2: CAIR is a "grass-roots organization" that depends financially on its members. Fact: According to an internal 2002 board meeting report, the organization received $33,000 in dues and $1,071,000 in donations. In other words, under 3 percent of its income derives from membership dues.

Claim 3: CAIR receives "no support from any overseas group or government."

Fact: Gaubatz and Sperry report that 60 percent of CAIR's income derives from two dozen donors, most of whom live outside the United States.

Specifically: $978,000 from the ruler of Dubai in 2002 in exchange for controlling interest in its headquarters property on New Jersey Avenue, a $500,000 gift from Saudi prince al-Waleed bin Talal and $112,000 in 2007 from Saudi prince Abdullah bin Mosa'ad, at least $300,000 from the Saudi-based Organization of the Islamic Conference, $250,000 from the Islamic Development Bank, and at least $17,000 from the American office of the Saudi-based International Islamic Relief Organization.

Claim 4: CAIR is an independent, domestic human rights group "similar to a Muslim NAACP."

Fact: In a desperate search for funding, CAIR has offered its services to forward the commercial interests of foreign firms. This came to light in the aftermath of Dubai Ports World's failed effort to purchase six U.S. harbors in 2006 due to security fears. In response, CAIR's chairman traveled to Dubai and suggested to businessmen there: "Do not think about your contributions [to CAIR] as donations. Think about it from the perspective of rate of return. The investment of $50 million will give you billions of dollars in return for fifty years."

Multiculturalism:
California's educrats have put out new rules for teaching Islamic studies to seventh-graders in public schools, and they are as biased as ever. They'll also likely spread eastward.

The lesson guidelines adopted by the bellwether state whitewash the violence and oppression of women codified in Islamic law, or Shariah. And they're loaded with revisionist history about the faith.

For example, the suggested framework glorifies Shariah as a liberal reform movement that "rejected" the mistreatment of women that existed in Arabia before Muhammad and his successors conquered the region, according to Accuracy in Academia.

The guidelines claim that Islamic law established for the first time that men and women were entitled to equal "respect."

Not so, says Islamic scholar and author Nonie Darwish, who grew up Muslim in Egypt.

"I am shocked that that is what they teach," she said. "Women had more rights in Arabia before Shariah."

In fact, "wife beating is allowed under Shariah" today, she added. "It allows a woman seen without a headdress to be flogged, punishes rape victims, and calls for beheading for adultery."

California's course on world religions also omits Islam's long history of jihadist violence, while portraying Christianity as an intolerant and bloodthirsty faith.

Christianity isn't given equal time, either. It's covered in just two days — as opposed to up to two weeks for Islam — and doesn't involve kids in any role-playing activities like the Islam unit.

Students do get a healthy dose of skepticism about the Christian faith, including a biting history of its persecution of other people.

Islam, in contrast, gets a pass from critical review. Even jihad is presented as an "internal personal struggle to do one's best to resist temptation," not waging holy war.

"California schools are pushing an unbalanced religious agenda that favors Islam and minimizes Christianity and Judaism," Accuracy in Academia warns in its latest Campus Report.

Who helped build the California Education Department's framework for Islamic studies? Islamist "scholars" with the Council on Islamic Education, or CIE, a Saudi-tied activist group.

The consultancy changed its name after former IBD Washington bureau chief Paul Sperry, author of "Infiltration: How Muslim Spies and Subversives Have Penetrated Washington," exposed that its chief researcher and textbook consultant for years taught social studies at a Saudi madrassa just outside Washington.

The Islamic Saudi Academy is a breeding ground for terrorists, including the valedictorian-turned-al-Qaida agent recently sentenced to life for plotting to assassinate President Bush.

Muslim Mafia ExposedCAIR’s foreign funding, ties to terrorism, position on honor murders

P. David Gaubatz and Paul Sperry, with the help of Gaubatz’s son Chris, who went undercover, have published an important, perhaps even an explosive and sensational book which exposes the Muslim-Brotherhood connected Council on American-Islamic Relations, otherwise known as CAIR.

The book is carefully researched and far too detailed for any one reviewer to summarize in a single review.

The authors dub CAIR and other similar groups, the Muslim Mafia in America; indeed, the title of their book is: Muslim Mafia. Inside the Secret Underworld That’s Conspiring to Islamize America. They document CAIR’s foreign funding sources, ties to fundamentalists and terrorists, (including the Muslim Brotherhood and Al-Qaeda), CAIR’s legally aggressive tactics which are meant to censor free speech as well as the truth about Islamic jihad and fundamentalism in the name of alleged “Islamophobia”—and of course, their brazen lies.

According to the scholar Daniel Pipes, CAIR has lied about their membership size (it is not 50,000 but 5, 133); lied about how many Muslims actually live in America (it is not 7 million but more like 2.3 million); lied about the source of their financial support (most comes from the Arab Middle East), lied about being a grassroots group, etc.

I can assure you that CAIR has also consistently lied about honor killings in North America.

Most recently, CAIR funded the lawyers for Fathima Rifqa Bary’s parents (she’s the Muslim teenager who converted to Christianity and ran away after she said her father had threatened to kill her). CAIR and their lawyers insisted that Rifqa had never been abused or threatened, that apostates are never killed by their Muslim families or communities. They specifically told Florida law enforcement authorities that there is no such thing as an honor killing in Islam. CAIR’s usual line is that every community has its share of “domestic violence.”

However, in a previous study in Middle East Quarterly, and in a new, forthcoming study which will appear in MEQ as well, I have shown that honor killings and western-style domestically violent femicides are very different. Although some Hindus and some Sikhs do commit honor murders, this is mainly a Muslim-on-Muslim and male-on-female crime.

In addition, according to Dr. Rusty Shackleford (MyPetJawa) in the Washington Times:

“A source who infiltrated a strategy session convened by the Muslim Brotherhood-associated Council on American Islamic Relations, reported that CAIR “handed out copies of [a recent] Orlando Sentinel article [that was critical of Rifqa Bary] and want supporters to push the meme that Christians have brainwashed and abducted this gullible teenage girl. They also have instructed supporters to circulate rumors that Rifqa had been carousing with infidel boys and engaged in acts of immorality. This CAIR strategy takes the focus off the near-universal Islamic legal precepts and Quranic injunctions that demand death for apostates and impugns the character of the innocent girl at the center of this controversy who appears to be in genuine fear for her life if she is returned to her parents.” Read more ...

CAIR's Traitorous Cop Ally

If the Taliban catches an American spy, they slit the informer's throat. If we catch a pro-Taliban spy, he gets a slap on the wrist after getting a letter from a Muslim pressure group urging leniency. Who says we're winning this war?

Last month, Taliban fighters claimed to have killed a "female U.S. spy" for helping American forces in Afghanistan. Once all the evidence against the alleged spy was gathered, they slit her throat with a knife.

Compare that with the kid glove treatment of Sgt. Muhammad Weiss Rasool, a Muslim cop in the nation's capital who tipped off the target of an FBI terrorism investigation into a pro-Taliban mosque.

Despite his arrest, confession and recent conviction in federal court, Rasool, an Afghan immigrant, will do no jail time and will continue to collect a paycheck from taxpayers pending the results of an internal-affairs probe by the Fairfax County Police Department outside Washington. Read more ...
