When Will Westerners Stop Westernizing Islamic Concepts?

Crescent
By Raymond Ibrahim | August 25

Recently, Cathy Lynn Grossman of USA Today wrote an article about Muslim zakat, wherein I was referenced as a "critic of Islam." She then followed up with another article titled "Critic questions the aims and ends of Islamic charity," dedicated to examining my views on zakat.

While I appreciate Ms. Grossman's initiative, what especially interests me is that her response exemplifies the problems originally highlighted in my article, "The Dark Side of Zakat: Islamic Charity in Context," which Ms. Grossman takes to task.

I had written: "From what American schoolchildren are being taught by their teachers to what Americans are being told by their presidents, concepts unique to Islam are nowadays almost always 'Westernized.'… [T]his phenomenon has resulted in epistemic (and thus endemic) failures, crippling Americans from objectively understanding some of Islam's more troublesome doctrines."

It is, therefore, a bit ironic that Ms. Grossman's entire article is a testimony to this phenomenon. For starters, even though I indicated Muslims are actually forbidden from bestowing zakat onto non-Muslims, her opening sentence stubbornly describes zakat as a "mandate to be charitable." Surely "charity" that discriminates according to religion cannot be deemed all that "charitable," a word that, in a Western context, is connotative of universal beneficence.

Ms. Grossman is also decided that Muslims engaged in that timeless Islamic phrase fi sabil Allah—most literally, "the path of Allah"—include "anyone from seminary students to imams to missionaries"; conversely, I supposedly read it "as a straight pipeline to violent jihadists."

Fair enough. Unfortunately, however, when it comes to the significance of Islamic terminology, neither her opinion nor mine matters much; how Islam's authoritative schools of jurisprudence (specifically, the four madhahib) have interpreted fi sabil Allah is all that matters. And Islam's juridical rulings are such that fi sabil Allah is synonymous with the concept of violent jihad.

For example, in its section on zakat, the Arabic-English edition of the standard legal text, 'Umdat as-Salik, translates fi sabil Allah as "those fighting for Allah." Next to the index entry for fi sabil Allah, it simply says "see jihad."

The following zakat-related anecdote from Islamic history is further illuminating: After Muhammad's death in 632, several Arab tribes, while still identifying themselves as Muslims, refused to pay zakat, much of which was being used to fund ongoing military operations. Abu Bakr, the first "righteous" caliph, responded by launching the Apostasy Wars, which claimed the lives of tens of thousands of Arabs. In this context, neither the uses of zakat, nor Abu Bakr's murderous response, seem very "charitable." (Who ever heard of killing people for not being "charitable" enough?) Read more here ...

Kuwait Islamic Bank Successfully Imposes Shariah in the USA, Courtesy of UDR

Sharia Finance

Earlier today, we posted a link to an article which mentioned that Kuwait Islamic Bank had entered into a joint venture with Colorado-based real estate company UDR:

http://www.shariahfinancewatch.org/blog/2009/08/17/shariah-compliant-sovereign-wealth-funds-resume-investing-in-west/

We were curious as to what, if any, restrictions were to be imposed on the real estate properties in which Kuwait Islamic Bank invested here in the United States, so we made an inquiry via UDR’s “contact us” form on the company’s web site.

The company was quick to reply as, within minutes, we received a phone call from Dave Messenger, CFO of UDR.

I asked Mr. Messenger two questions:

1. What, if any, special restrictions or qualifications relating to Shariah were required in the deal with Kuwait Islamic Bank?

2. Are zakat payments to be made as part of this venture?

Mr. Messenger did not attempt to address question number 2, but referred me to Kuwait Finance House to get an answer to that question.

Mr. Messenger was also quite insistent that UDR’s agreement was in fact with Kuwait Finance House and not with Kuwait Islamic Bank. We regard this as a distinction without a difference, since Kuwait Finance House is an arm of Kuwait Islamic Bank. In all the media being devoted to this new deal, the entity identified is in fact Kuwait Islamic Bank.

Mr. Messenger was able to provide much more information in response to question number 1.

His answer was troubling, right from the outset.

First of all, he mispronounced “shariah.” Shariah is pronounced shu-ree-uh. Messenger pronounced it shu-rye-uh.

It does not inspire a great deal of confidence in terms of due diligence when the CFO of the American entity which entered into the agreement with an Islamic bank cannot even correctly pronounce the name of the underlying doctrine which governs their joint venture partner.

Messenger was not bashful at all about the issue of shariah-compliance.

He declared that the entire agreement was written to be shariah-compliant to make sure that the joint venture properties fit in with their partners’ religion.

When asked about specific provisions which he knew about to establish and maintain shariah compliance, Messenger named two: “cinematography and food served on the property.”

I asked what he meant by cinematography and he explained that some of their properties include movie theaters.

Evidently, Kuwait Finance House/Kuwait Islamic Bank wants to make sure that no offensive movies are shown on properties in which they invest.

In terms of “food served on property” Messenger explained that no pork would be served on the property at functions put on by UDR.

I asked him if any of the properties leased to sandwich shops or delis or such. He said that 8 of their 160 properties did have such tenants.

Again, evidently, those businesses would be prohibited from serving pork to prevent any conflict with shariah or the religion of UDR’s venture partners.

Messenger explained that potential conflicts with shariah were addressed up front with the JV partners and would continue to be addressed up front to prevent conflicts.

What has clearly happened here is that Kuwait Islamic Bank has been able to impose shariah here in the United States by using its financial leverage over UDR.

This is the essence of Shariah-Compliant Finance.

United States' Speech to Islamic World: half-Truths about Koran, historical Falsehood, Charity to Terrorists

Obama

Sound and Fury in Cairo

Friday, June 05, 2009 - by Baron Bodissey

At least 95% of Barack Hussein Obama’s speech yesterday in Cairo was feel-good boilerplate. It was mostly a batch of unremarkable oats for the nose-bags of all those Birkenstockers and Trustafarians back in the United States who were responsible for his election.

But as for the rest… Well, most of the rest consisted of blatant pandering to the “Muslim World”. And there were a few scary parts, such as this sentence, which had nothing whatsoever to do with Islam:

And I want to particularly say this to young people of every faith, in every country — you, more than anyone, have the ability to reimagine the world, to remake this world. [emphasis added]

Let’s remake this world.Ladies and gentlemen, this is a fascist pronouncement. People who want to remake the world slide inexorably into totalitarianism, because they have to act against that annoying and persistent impediment known as “human nature”. The 20th century was strewn with millions of corpses in mass graves and killing fields as the result a variety of ideologies that attempted to remake the world.Thank God for the ongoing financial crisis, which will serve to reduce the ability of Barack Hussein Obama to realize his grandiose dreams.

Other bloggers and writers have provided excellent analyses of this speech. Robert Spencer does the best job of fisking it at Jihad Watch, and Melanie Phillips and Caroline Glick have supplied their own pertinent commentary.

Mr. Obama said:

Now, much has been made of the fact that an African American with the name Barack Hussein Obama could be elected President.Actually, this topic was off-limits in polite society before the election. Pamela at Atlas Shrugs reminds us that much was not made of “Hussein”:

Obama deceitfully hid his Muslim background and schooling and his agenda. Little did America know that Obama’s objective would be a conversion of this nation to “the largest Muslim country in the world”.

The President spoke at length about the Arab-Israeli conflict, displaying the mealy-mouthed “moral equivalence” that so often characterizes the rhetoric of Western leaders:

For decades then, there has been a stalemate: two peoples with legitimate aspirations, each with a painful history that makes compromise elusive.

But not all of his examples were this even-handed. As Yid With Lid points out, the President singled out the Holocaust and European anti-Semitism without even hinting at the single greatest sinkhole of anti-Semitism in our own time: the Muslim Middle East.

Mr. Obama also proudly cited the Koran:

The Holy Koran teaches that whoever kills an innocent is as — it is as if he has killed all mankind. The passage referred to above is part of 5:32:

Therefore We prescribed for the Children of Israel that whoso slays a soul not to retaliate for a soul slain, nor for corruption done in the land, shall be as if he had slain mankind altogether; and whoso gives life to a soul, shall be as if he has given life to mankind altogether. Our Messengers have already come to them with the clear signs; then many of them thereafter commit excesses in the earth. The President neglected to mention the verse immediately following it (5:33), which says:

This is the recompense of those who fight against God and His Messenger, and hasten about the earth, to do corruption there: they shall be slaughtered, or crucified, or their hands and feet shall alternately be struck off; or they shall be banished from the land. That is a degradation for them in this world; and in the world to come awaits them a mighty chastisement.

This text is bad enough in itself , but it should also be noted that the phrase “those who fight against God and His Messenger” is widely interpreted by mainstream Islamic scholars to mean anyone who opposes Muslims and resists the spread of Islam.

Yet if you believe Barack Hussein Obama, Islam means “tolerance”. He said:

Islam has a proud tradition of tolerance. We see it in the history of Andalusia and Cordoba during the Inquisition. I saw it firsthand as a child in Indonesia, where devout Christians worshiped freely in an overwhelmingly Muslim country. That is the spirit we need today. People in every country should be free to choose and live their faith based upon the persuasion of the mind and the heart and the soul. This tolerance is essential for religion to thrive, but it’s being challenged in many different ways.

Let’s overlook the putative tolerance of the past and consider the facts on the ground right now, in the tenth year of the 21st century. If Islam is so tolerant, why have we seen all the Muslim-majority countries — Pakistan, Egypt, Saudi Arabia, Iraq, Iran, Turkey, etc. — steadily drained of their Christian, Jewish, and Hindu populations?

Stories like this one from Asia News have become more and more frequent in Islamic countries under the influence of Salafist doctrine:

Non-Muslims in villages along the northern Afghan-Pakistani border are forced to pay the jizya. Lashkar-e-Islam wants a thousand rupee per adult male to allow non-Muslims to live there with the right to travel. In Orakzai area the Taliban take over two stores and various houses owned by Sikhs. Some families are forced to pay up to 20 million rupees in order to stay.

Non-Muslims have to pay if they want to retain their religion and live among Muslims. It’s worth noting that exactly the same system was in force in Cordoba and Andalusia a thousand years ago, during the “Golden Age of Islam”.

* * * * * * * * * * * * * * *

A couple of Gates of Vienna readers have contributed their own observations about the President’s speech. First a reaction to this passage from the speech:

As a student of history, I also know civilization’s debt to Islam. It was Islam — at places like Al-Azhar University — that carried the light of learning through so many centuries, paving the way for Europe’s Renaissance and Enlightenment. It was innovation in Muslim communities that developed the order of algebra; our magnetic compass and tools of navigation; our mastery of pens and printing; our understanding of how disease spreads and how it can be healed. Islamic culture has given us majestic arches and soaring spires; timeless poetry and cherished music; elegant calligraphy and places of peaceful contemplation. And throughout history, Islam has demonstrated through words and deeds the possibilities of religious tolerance and racial equality.

This is Fjordman’s response:

Is there even a single truthful statement in this entire paragraph? Perhaps they had some nice calligraphy, and a few Muslim scholars, especially al-Khwarizmi and Omar Khayyam, made contributions to algebra, but apart from that it’s almost total nonsense. The magnetic compass was invented by the Chinese, and possibly by Europeans independently. Printing of books was invented by the Chinese and stubbornly and persistently rejected by Muslims for a thousand years or more due to Islamic religious resistance. Al-Azhar focused on Islamic religious learning — sharia law — not on natural philosophy or science, as did European universities. This is why arguably the greatest original scientific work ever written in the Arabic language, Alhazen’s Book of Optics, was written in Cairo but almost totally ignored in the Arabic-speaking world afterward, including at al-Azhar in Cairo. It was studied in Europe.Modern algebra, too, was developed in Europe. Muslim scholars did not understand how disease spread or how it could be cured. This was proved in late nineteenth century Europe with scholars such as the great Frenchman Louis Pasteur and the German Robert Koch. The germ theory of disease could only be proven after the creation of sufficiently powerful microscopes. The microscope was an exclusively European invention with no known equivalent anywhere else in the world.

Concerning Islamic charitable giving, or zakat, the President said:

For instance, in the United States, rules on charitable giving have made it harder for Muslims to fulfill their religious obligation. That’s why I’m committed to working with American Muslims to ensure that they can fulfill zakat.A reader sent this response by email:

Given that we know that zakat is used “for Allah’s cause” (i.e. for mujahideen, those fighting in holy battle, jihad), could BHO’s support for it — if he proposes legislation to that effect — be grounds for impeachment in that he is failing to protect the US since zakat is inherently seditious against non-Islamic governments and their peoples?

Of course, it would also be grounds for any congressmen/women to oppose such legislation, so it is essential that we get this info out on as many sites as possible. Also, if we can put this point across about zakat, it can form the basis of suing mosques and other recipient organizations of zakat, as third-parties in legal cases against Islamic terrorism. I noticed a few years back a US court granted in favor of people whose relatives had been killed by Moslem terrorists and the US court found Iran ‘guilty’, but of course no costs could be recovered. If we can show that all mosques do collect zakat, then we have a basis for helping to dismantle the financial strength of jihad worldwide. These mosques and “charities” are the real conduits for terrorism; dismantle them with lawsuits and expose their seditious natures and that is half the battle.

Shariah Finance Watch is thinking along the same lines: any laws that are passed to enable shariah finance are by definition unconstitutional, and are vulnerable on First Amendment grounds.

* * * * * * * * * * * * * * *

There is much, much more that could be said about yesterday’s speech in Cairo. Whole dissertations could be written about the dissimulations, exaggerations, and untruths contained in Mr. Obama’s words.

However, I’ll leave it at that for now.

I’d like to think this is the last bit of pandering to Islam that we will see from our current president. Unfortunately, it’s in all likelihood just the beginning of his administration’s plunge into complete dhimmitude.

Now you can finance the jihad right from your local ATM!

ATM
Regular readers of SFW know that one of the chief concerns about Shariah-Compliant Finance is the system of tithing known as “zakat.”

Shariah-Compliant banks provide a means by which Muslims can tithe their investment earnings and, in the case of one bank in the UAE, Sharjah Islamic Bank, they are using technology to enable customers to move funds from their accounts with the bank to a charity, ’The Dirham of Good.’

This should serve as definitive proof that zakat is in fact a key component of Shariah-Compliant Finance. Many Western promoters of Shariah-Compliant Finance have downplayed the significance of zakat, even to the point of claiming total ignorance of the whole zakat system.

There are many problems illustrated by the article linked below about Sharjah Islamic Bank and ’The Dirham of Good.’ Read more ...

Charities and Terrorism

Zakat
By Phil Leggiere

New paper examines how Al Qaeda uses moderate Muslims to ‘microfinance” terror

Terrorist networks and organizations have many “underground” means of financing themselves, from drug smuggling to cybercrime. As challenging as these clandestine methods are to globally eradicate, an equally vexing problem is how to shut-off jihadist funding siphoned off from so-called “legitimate” charities.

Addressing that problem, according to Tolga Koker Department of Economics and Carlos Yordan Department of Political Science Drew University, means addressing the question of why tens of thousands of Muslims who are not terrorists and often opposed themselves to terrorism nonetheless support the work of charities that support jihadist operations. Their new paper, titled Microfinancing Terrorism: A Study in Al Qaeda Financing Strategy, published Tuesday by the Social Science Research Network, tries to do just that. Read more ...

Ex-Diplomat Defends Zakat Committees, HLF Defense Rests

HLF
DALLAS – Defense attorneys for five men accused of illegally routing millions of dollars to Hamas rested their case Thursday after hearing from a former diplomat who questioned government claims that a series of Palestinian charities were controlled by the terrorist group.

Edward Abington, a former consul general at the U.S. consulate in Jerusalem, said he met with members of the charities, known as zakat committees, in Hebron, Ramallah, Nablus, Jenin, Gaza from 1993-97. Though he was briefed by U.S. government officials, he was never told of any Hamas connection.

Abington said his office received "very strict instructions" from the U.S. government that consulate officials were not to have any interaction with Hamas. But "I had no information as consul general that Hamas controlled any zakat committees," he said. There was no official policy restricting communication with the committees.

That assertion is at odds with the heart of the government's case – that the men, in running the Holy Land Foundation for Relief and Development (HLF) routed millions of dollars to Hamas through the committees. But under cross examination, Abington acknowledged he was unaware of information being gathered by criminal investigators and even the Palestinian Authority. Earlier in the trial, prosecutors presented a former HLF fundraiser who told jurors he was certain his donations to HLF would help Hamas. Read more ...

Israeli Official Details Zakat Committee Links to Hamas

HLF
DALLAS – Palestinian charities receiving millions of dollars from the Holy Land Foundation for Relief and Development (HLF) were controlled by Hamas throughout the time they received the Texas-based charity's money, a lawyer for the Israeli Security Agency testified Wednesday and Thursday.

That opinion is based on the presence of Hamas leaders and activists serving in "key leadership roles" on the committees and the committees' work advancing the terrorist group's goals, said the lawyer, testifying anonymously under the pseudonym "Avi." He has been accepted as an expert witness on Hamas financing and social programs based upon his years of research in Israeli criminal probes.

And his opinion is based further on the presence of internal Hamas documents and propaganda items hyping the group in charity offices - even schools.

Five former HLF officials are accused of conspiring to provide material support to Hamas, largely through donations to Palestinian charities, known as zakat committees, which prosecutors say are controlled by Hamas. Avi, expected to be the final prosecution witness, is tasked with proving that connection. Read more ...
