CAIR concedes it doesn't legally exist

The Council on American-Islamic Relations' latest legal brief in its "Muslim Mafia" lawsuit provides no evidence it suffered damages and effectively concedes it filed the complaint under a false name, concludes a lawyer defending a father-and-son team that conducted an undercover probe to document the Muslim group's ties to terrorism.

CAIR's reply to a motion to dismiss its lawsuit against former Air Force special agent P. David Gaubatz and his son Chris, who served a six-month CAIR internship posing as a young Muslim convert, "concedes that they don't have any legal damages, but they hope they'll find some," said attorney Daniel Horowitz, who filed the motion to dismiss in December.

CAIR alleges the Gaubatzes obtained access to the Muslim group's property under false pretenses, removed internal documents and made recordings of officials and employees "without any consent or authorization and in violation of his contractual, fiduciary and other legal obligations to CAIR."

However, asserted Horowitz, CAIR is on a "fishing expedition," filing a lawsuit with the hope that "after the expenditure of unknown amounts of money and time, it might find some damages."

"If CAIR is conceding that they have no interests that prevent the materials from being disclosed, what is their excuse for trying to suppress the book?" Horowitz asked. "It's about time the American public put an end to these legal abuses by CAIR."

In his motion to dismiss, Horowitz argued that CAIR is unable to demonstrate it suffered harm and, furthermore, has no claim because the group does not legally exist. Horowitz explains that CAIR changed its name to the Council on American-Islamic Relations Action Network almost immediately after it was named by the Justice Department as an unindicted co-conspirator in the largest terror-finance case in U.S. history.

As WND reported yesterday, the Gaubatzes' legal counsel, in compliance with a subpoena served by the FBI, turned over to federal authorities 12,000 of pages of internal CAIR documents obtained in the undercover probe that allegedly confirm the D.C.-based Muslim group's role as a front for terrorist groups that seek Islam's domination over the U.S.

The documents provided key material for the book "Muslim Mafia," co-authored by David Gaubatz and "Infiltration" author Paul Sperry. The authors assert CAIR is acting as a front for a conspiracy of the Muslim Brotherhood – the parent of al-Qaida and Hamas – to infiltrate the U.S. and establish Saudi-style Islamic law.

Horowitz contends CAIR's reply does not address his allegation that the group used a non-existent entity to file the lawsuit, "dismissing the use of the wrong name by calling it a 'misnomer.'"

"This is not like confusing the name 'Dan' with 'Don' or 'Tim' with 'Tom'," Horowitz said.

"CAIR forms groups, dissolves them, takes credit for them or disclaims them as it sees fit," he said.

The legal name change in May 2007 to Council on American-Islamic Relations Action Network, for example, came just two weeks after the Justice Department's designation of CAIR as an unindicted co-conspirator in the prosecution of the Holy Land Foundation. The Texas-based group was convicted of channeling funds to the Palestinian terrorist group Hamas.

Horowitz points out that when he defended Michael Savage in CAIR's case against the radio talk host, CAIR's own attorneys appeared separately for CAIR and for CAIR Action Network, or CAIR-AN.

"CAIR and CAIR-AN are two distinct corporate entities," he said, "and while CAIR-AN may be a successor to CAIR, the name problem goes far deeper than mistakenly using a predecessor corporation."

'Negative light'

In its legal reply to Horowitz, CAIR concedes it cannot sue over First Amendment-protected activities such as publishing information about the organization.

But Horowitz argues that CAIR, nevertheless, focuses its entire complaint "on the attacks on its self-proclaimed character as a civil rights organization."

CAIR, he points out, says Chris Gaubatz' mission was both to collect and to "misappropriate information" that was "to later be disclosed publicly and used to cast CAIR in a negative light."

Those actions, CAIR claims, "caused CAIR and its officials and employees to suffer unwarranted harassment up to and including threats of violence."

But Horowitz argues that in CAIR's legal briefs, "no specific threats are alleged and no attempt is made to show that the alleged wrongful conduct had any relation to the alleged threats."

He also points out CAIR's original pleading does not make it clear that the documents taken from CAIR were consigned to the shredder.

CAIR says in its reply brief that much of "Muslim Mafia" is "devoted to critiquing CAIR" and, contrary to the defendants' claims, is "a decidedly unserious book that only warrants CAIR's attention due to the criminal and tortious conduct which it admits Defendants perpetrated upon CAIR."

Horowitz calls that statement another concession by CAIR that it suffered no damages.

"If all that warrants 'CAIR's attention' is the alleged 'criminal and tortious conduct,' there is simply no federal jurisdiction," he contends.

Horowitz calls CAIR's complaint "an impermissible end run around First Amendment protections."

"The fact that 'CAIR' is upset or that members may have been threatened does not weaken the First Amendment protections," Horowitz argues.

CAIR's claim of breach of fiduciary duty and breach of contract is based on its allegation thath Chris Gaubatz signed a confidentiality agreement when he began his internship. But CAIR has not been able to produce evidence any agreement was ever signed, and Horowitz says that even if signed, "this document would have been signed between a non-existent corporate entity and Chris Gaubatz. There need to be two parties to a contract."

FBI raid on Detroit mosque leads local Muslims to redouble efforts to cooperate with authorities -- no, wait...

Actually -- surprise! -- the local Muslims are angry about the FBI's use of informants.

Apparently no one is allowed to know what is going on inside the mosques, and we are all supposed to take it on trust that inside them they are preaching love for non-Muslims, peaceful coexistence with them as equals on an indefinite basis, equality of rights for women, the importance of the Constitution's non-establishment of a state religion, and the virtues of a non-Sharia state.

He called himself Jabril. Two years ago, a white man who claimed he was an ex-con and convert to Islam started attending a predominantly African-American mosque on a run-down street in Detroit.

He touted his Islamic ways while offering poor members of the mosque cash for odd jobs at an auto shop on the city's west side. He told tales of sick family members and brought a young boy to the mosque who he said was his son.

Jabril soon became a brother in faith and a confidante of the mosque's fiery leader, Luqman Ameen Abdullah, who was killed in a shootout during an Oct. 28 raid by FBI agents to arrest men suspected of dealing in stolen goods.

Members now believe Jabril was an FBI informant who infiltrated their mosque.

"He built up trust in the community," said Omar Regan, 34, one of Abdullah's sons.

The case -- one of several in the past year involving informants in Muslim-American communities -- has prompted growing concern among Muslims and civil rights advocates about undercover surveillance in religious institutions.

Federal officials say they don't send informants into congregations without reason. But last week, U.S. Rep. John Conyers, a Detroit Democrat, called upon the U.S. Justice Department to review its policies on using informants in houses of worship. [...]

For two years, the man known as Jabril to many at Masjid Al-Haqq ingratiated himself with members of the mosque, according to Abdullah's followers. They accepted him as a brother in Islam.

On Oct. 28, Regan said Jabril asked mosque members to help him move some goods in a Dearborn warehouse. Authorities said the men were there to deal in stolen items.

Once inside the warehouse, Jabril reportedly told the mosque members: "I'm going to go get some water, a drink of water," Regan said in an interview with the Free Press.

Jabril then disappeared.

Moments later, federal agents stormed inside. Abdullah, 53, was shot dead by FBI agents after an exchange of fire during the raid.

Jabril was never seen again by members of the mosque.

The story of Jabril's alleged infiltration offers a rare look into the use of FBI informants in Muslim-American communities in the aftermath of Sept. 11, 2001. Members of the Detroit mosque say they believe Jabril was a key undercover informant in helping the FBI build a case against Abdullah and his followers.

Muslim advocates say there's a growing problem of improper use of informants, particularly in houses of worship. Some accuse the informant of luring Abdullah to his death in the fatal shooting, which has raised questions about excessive force.

But the FBI and federal prosecutors have said that agents acted appropriately in trying to apprehend members of a criminal operation led by Abdullah. They said the group preached violence and hatred against law enforcement and non-Muslims.

Abdullah and his followers were not charged with any acts of terrorism. The charges against the 11 men arrested include dealing in stolen goods such as laptops and fur coats, firearms violations and tampering with vehicle identification numbers. The criminal complaint, however, highlights the radical views of the group. "America must fall," Abdullah once said, according to the complaint.

While some Muslim leaders have expressed concern about civil rights, federal officials say informants are vitally needed, especially with the recent surge in domestic terrorism....

Muslim Brotherhood Member Becomes Illinois Police Chaplain

The Illinois State Police’s first Muslim chaplain, Sheikh Kifah Mustapha, is listed as an unindicted co-conspirator in the terrorism financing trial of the Holy Land Foundation and a member of the radical Muslim Brotherhood organization by the federal government, reports The Investigative Project on Terrorism.

The list that was drawn up as a result of the trial says that Mustapha is a member of the Muslim Brotherhood’s Palestine Committee, a group set up to secretly support the Hamas terrorist group in the United States.

He also worked as a fundraiser for the Holy Land Foundation until 2001 when the government shut the non-profit group down for financing Hamas. Prior to that, he worked for the Islamic Association of Palestine, another Hamas front that was shut down.

It’s not clear whether the Illinois State Police knew about these connections and didn’t care, or whether it failed to adequately research Mustapha’s background. Either raises serious concerns about who will counsel the state’s Muslim troopers,” IPT says.

The IPT report says that Mustapha has also helped raise money for the Council on American-Islamic Relations, another group tied to the Muslim Brotherhood that was listed as an unindicted co-conspirator in the trial of the Holy Land Foundation, and the Muslim-American Society.

CAIR is currently the subject of a book by Dave Gaubatz and Paul Sperry titled “Muslim Mafia” that alleges the group supports extremism and engages in criminal activity including fraud in order to support Hamas and the Muslim Brotherhood.

The suborning of American intelligence

People in America are often shocked to discover the extent to which the authorities in Britain have been taken in by the Islamists of the Muslim Brotherhood, to such an extent the UK government and police use them as advisers on combating Islamic extremism.

Americans would be even more shocked to discover that exactly the same thing is going on in their own backyard.

Pajamas TV features two interviews with former US security people, one described merely as having been given some kind of intel-gathering assignment by the ‘joint chiefs’ and the other described as a ‘former FBI special agent’.

The first describes how, when he discovered to his alarm that there was not only no evidence that Islamic radicals were wrong in Islamic law but that there were no counter-arguments to them in that law, the US intel/law enforcement community that had instructed him just didn’t want to know.

The second, the ex-FBI man, is even more alarming. He states that the American counter-terrorist establishment has allowed itself to be infiltrated by radical Islamists -- to whom counter-terrorism officials are going for advice and training in countering Islamic radicalism.

Every major Muslim representative organisation in the US, he says, is a Muslim Brotherhood front. Hamas fronts such as CAIR are used by the US authorities for outreach to the Muslim community in America. They are invited to sit in on brainstorming sessions about investigative techniques, and are actually training the FBI. ‘The Muslim Brotherhood are telling us how to fight them’, he says.

The PJTV interviewer seemed stunned by this unbelievable situation. But it’s exactly what’s happening in the UK, too, where the Brotherhood are used – incredible as this sounds – as an antidote to radicalisation and as interlocutors in good faith with the Muslim community.

In the US, this profound and wilful institutionalised ignorance of the religious war being waged against the free world revealed itself most catastrophically recently when seven CIA officers, amongst them some of the most experienced and valuable, were blown up by a Jordanian triple agent. Not only were they duped, but it seems their professional training went by the board in inviting such a man onto their base and with so many of them clustering around him. As the Washington Post reported:

‘The tradecraft that was developed over many years is passé,’ complained a recently retired senior intelligence official, also with decades of experience. ‘Now it’s a military tempo where you don't have time for validating and vetting sources. . . . All that seems to have gone by the board. It shows there are not a lot of people with a great deal of experience in this field. The agency people are supporting the war-fighter and providing information for targeting, but the espionage part has become almost quaint.’

Endemic ignorance, sloppiness, incompetence -- even now, even after 9/11, even after the restructuring which was supposed to remedy the dysfunctionality and turf wars between intelligence agencies but which – as was predicted at the time – has merely stuck another layer of bureaucracy on top.

And if one thinks back to the systematic failure over decades to identify and analyse correctly the rise of Islamism and before that, the imminent collapse of Soviet communism, one has to ask oneself the terrifying question whether US intelligence really is fit for purpose at all.

POST 911 SUBVERSION: Institutionalized Islamic Propaganda as Dictated by "Society of Professional Journalists"

Absolute intellectual/informational dominance is the strategic goal.

In case you ever wondered why you never got the straight story on Islam directly after 911, and why the media seemed to be in the tank for jihad, here's a clue.

The Society of Professional Journalists issued this directive a couple of weeks after 911. And they have followed it in goose step ever since.

Just how long has the Muslim Brotherhood been strategizing the take down and take over of the US and the west? Decades.

And while we have no strategy for fighting the enemy -- hell, we can't even name them -- they have a war plan that is so detailed and exact that every t is crossed and every i dotted.

Take a look at the "diversity" guidelines as set forth by the Society of Professional Journalists not two weeks after 911. The enemy that attacked our country in an attempt to bring it down was writing the narrative.

Diversity Guidelines

On Oct. 6, 2001 at its National Convention in Seattle, the Society of Professional Journalists passed a resolution urging members and fellow journalists to take steps against racial profiling in their coverage of the war on terrorism and to reaffirm their commitment to:

Use language that is informative and not inflammatory;

Even if the horror, murder and bloodshed of jihad is inflammatory, don't tell the people.

— Portray Muslims, Arabs and Middle Eastern and South Asian Americans in the richness of their diverse experiences;

Portray the axe wielding murderers, the homicide bombers, the infiltrators of our most senior levels, in the "richness of their diverse experience" (you know, stonings, amputations, shariah law, clitorectomies, Jew hatred, Islamic colonialism, the caliphate..........)

— Seek truth through a variety of voices and perspectives that help audiences understand the complexities of the events in Pennsylvania, New York City and Washington, D.C.

Visual images

— Seek out people from a variety of ethnic and religious backgrounds when photographing Americans mourning those lost in New York, Washington and Pennsylvania.

Seek out Muslims ................

— Seek out people from a variety of ethnic and religious backgrounds when photographing rescue and other public service workers and military personnel.

— Do not represent Arab Americans and Muslims as monolithic groups. Avoid conveying the impression that all Arab Americans and Muslims wear traditional clothing.

Stories

Seek out and include Arabs and Arab Americans, Muslims, South Asians and men and women of Middle Eastern descent in all stories about the war, not just those about Arab and Muslim communities or racial profiling.

Cover the victims of harassment, murder and other hate crimes as thoroughly as you cover the victims of overt terrorist attacks.

Cover the bogus tales of "harassment" just days after 3,000 Americans were brutally murdered by Muslims on our own soil. The Press is being told to throw Americans under the bus and kiss the adherents to the Islamic ideology that murdered our people and want to take over this country.

Make an extra effort to include olive-complexioned and darker men and women, Sikhs, Muslims and devout religious people of all types in arts, business, society columns and all other news and feature coverage, not just stories about the crisis.

Try to show Muslims out of jihad. And don't talk about the Islamic attacks especially, right after they happen.

— Seek out experts on military strategies, public safety, diplomacy, economics and other pertinent topics who run the spectrum of race, class, gender and geography.

— When writing about terrorism, remember to include white supremacist, radical anti-abortionists and other groups with a history of such activity.

There aren't any (except the three under some rock in Appalachia). But not to worry, make it up, or pull the Unabomber out of your ass, and Timothy McVeigh too (just don't mention the third Muslim man).

— Do not imply that kneeling on the floor praying, listening to Arabic music or reciting from the Quran are peculiar activities.

— When describing Islam, keep in mind there are large populations of Muslims around the world, including in Africa, Asia, Canada, Europe, India and the United States. Distinguish between various Muslim states; do not lump them together as in constructions such as "the fury of the Muslim world."

But Obama does. The Islamic world does. The ummah is the worldwide global community.

— Avoid using word combinations such as "Islamic terrorist" or "Muslim extremist" that are misleading because they link whole religions to criminal activity. Be specific: Alternate choices, depending on context, include "Al Qaeda terrorists" or, to describe the broad range of groups involved in Islamic politics, "political Islamists." Do not use religious characterizations as shorthand when geographic, political, socioeconomic or other distinctions might be more accurate.

— Avoid using terms such as "jihad" unless you are certain of their precise meaning and include the context when they are used in quotations. The basic meaning of "jihad" is to exert oneself for the good of Islam and to better oneself.

— Consult the Library of Congress guide for transliteration of Arabic names and Muslim or Arab words to the Roman alphabet. Use spellings preferred by the American Muslim Council, including "Muhammad," "Quran," and "Makkah ," not "Mecca."

— Regularly seek out a variety of perspectives for your opinion pieces. Check your coverage against the five Maynard Institute for Journalism Education fault lines of race and ethnicity, class, geography, gender and generation.

The Maynard Institute for Journalism is "pure diversity" -- check out the front page. It's all Arab Muslims or African Americans.

— Ask men and women from within targeted communities to review your coverage and make suggestions.

In other words, ask Muslims for the taqiya and the right spin before you publish.

The Islamic infiltration, parts 1 and 2

Though exposed at the two Holy Land Foundation trials, CAIR et al. continue to operate as partners of the United States government.

At PJTV, Bill Whittle updates the story in an in-depth interview with an anonymous former FBI Special Agent in "The Islamic infiltration, part 1: Inside our government, armed with our secrets" and "The Islamic infiltration, part 2: From influence to insurrection."

These segments mimic the format of 60 Minutes, but Whittle and PJTV go where 60 Minutes fears to tread.

Muslims sue CAIR for fraud

Two civil lawsuits filed by Muslims alleging criminal fraud were served today against the Council on American-Islamic Relations, a self-described Muslim civil-rights group that has been named an unindicted terrorist co-conspirator by the Justice Department.

The cases filed in federal court in the nation's capital assert the D.C.-based CAIR was aware that its "resident attorney" and "manager for civil rights" at its now-defunct Maryland-Virginia chapter, Morris Days, was not an attorney and failed to provide legal services for Muslims who came to CAIR for help.

The complaint alleges CAIR purposefully conspired with Days to keep the clients from discovering that their legal matters were being mishandled or not handled at all, according to attorney David Yerushalmi, who is representing the five plaintiffs, three of whom are Muslims.

"CAIR has engaged in a massive criminal fraud in which literally hundreds of CAIR clients have been victimized, and because of the CAIR cover-up, they still don't realize it," Yerushalmi said. "The fact that CAIR has victimized Muslims and non-Muslims alike demonstrates that CAIR is only looking out for CAIR and its ongoing effort to bilk donors out of millions of dollars of charitable donations thinking they are supporting a legitimate organization."

Meanwhile, CAIR is engaged in a lawsuit it filed against a father and son who carried out a six-month undercover investigation of the Muslim group's terrorist ties. CAIR is suing P. David Gaubatz and his son, Chris Gaubatz, who posed as a Muslim in an internship with CAIR's national office in Washington.

During that period, the younger Gaubatz made audio and video recordings and took some 12,000 pages of documents destined for a shredder in an attempt, he said, to expose the group's ties to Islamic jihad and terrorism. Key evidence has been published in the book "Muslim Mafia," published by WND Books. His father is a former Air Force special agent with extensive Middle East experience who researches the spread of radical Islam in the U.S. and its threat to national security.

The two new lawsuits follow a previous suit centered on Days that alleged CAIR's fraudulent conduct amounted to racketeering, under federal RICO statutes. A court dismissed the RICO counts, concluding CAIR's conduct as alleged was fraudulent but not a technical violation of RICO. The plaintiffs in that case have appealed and are awaiting the circuit court's briefing schedule, Yerushalmi said.

The two new federal civil complaints were filed Jan. 6 in the federal district court for the District of Columbia.

The complaints say that according to CAIR internal documents, there were hundreds of victims of the fraud scheme.

The suits contend CAIR knew or should have known Days was not a lawyer when it hired him. Further, when CAIR officials were confronted with evidence of Days' fraudulent conduct, the complaints say, they conspired to conceal the fraud.

CAIR, the complaints assert, suggested Days was never actually employed by CAIR and concealed the fact CAIR had fired him once some of the victims began threatening to sue.

Obama taps Muslim for top job at Federal DHS

The Obama administration has tapped Los Angeles Deputy Mayor Arif Alikhan for a top job at the federal Department of Homeland Security.

KPCC’s Frank Stoltze says Alikhan immediately becomes one of the administration’s highest-profile Muslims.

Frank Stoltze: Arif Alikhan downplays his Sunni Muslim roots. That’s not always been easy. Not growing up in the San Gabriel Valley with a name like Alikhan.

Alikhan rose to chief of the Cyber and Intellectual Crimes Section and worked as a senior adviser to then-Attorney General Alberto Gonzalez in Washington. Now, after two years as L.A.’s deputy mayor for public safety, the 40-year-old returns to the nation’s capital as assistant secretary for the Office of Policy Development at the Department of Homeland Security.

Alikhan: This is the main sort of think tank and policy analysis shop that provides advice to the secretary, the deputy secretary, and spans over all of the different component departments of the Department of Homeland Security.

Stoltze: His first briefing book was a 90-page list of acronyms he’ll use on his job. He says a big part of his job will be fostering communication between agencies. Alikhan also wants to help improve America’s image with Muslims around the world.

Alikhan: I think a lot of people have learned from me about being Muslim, how diverse it is, how there is no real monolithic Islam out there, how Islam clearly, clearly prohibits any type of extremism or violence and absolutely condemns that.

Stoltze: He may get that opportunity to teach again at some of the highest levels of the federal government.

Wow. Is that the kind of blatant untruths we want taught at the highest levels of federal government, particularly DHS – a group created to protect us from terrorism – borne out of attacks on the U.S. by Muslims? Outright lies? More on Alikhan from Discover the Networks:

During his years in Los Angeles, Alikhan was responsible for derailing the Police Department’s plan to monitor activities within the Los Angeles Muslim community, where numerous radical mosques and madrassas existed, and where some of the 9/11 hijackers had received support from local residents.

Strongly anti-Israel, Alikhan has referred to the terrorist organization Hezbollah as a “liberation movement.” An affiliate of the Muslim Public Affairs Council, Alikhan opposed President George W. Bush’s prosecution of the war on Islamic terror.

Back in 2007, Alikhan was instrumental in removing the Muslim terror tracking plan in LA.

The controversial Muslim ‘Mapping’ Plan of the Los Angeles Police Department is now “dead on arrival” according to Chief William Bratton.

“It is over and not just put on the side,” said Chief Bratton in a meeting with the Muslim leadership of Southern California on Thursday, November 15th. The meeting was moderated by Deputy Mayor of Los Angeles, Arif Alikhan and attended by Deputy Chief Mike Downing.

Chief Bratton acknowledged the hurt and offense caused to Muslims and agreed to send a letter to the Muslim community announcing the official termination of the ‘mapping’ plan.

A major reason for the termination of the ‘mapping’ plan was the Muslim community’s vociferous opposition and active civic engagement in making themselves heard beyond Los Angeles. Muslim organizations demonstrated a strong unity of purpose and message on the issue of ‘mapping’ that led to a position of strength for Muslims in the meeting. Those involved in the initial phases of this controversy were the Islamic Shura Council of Southern California, the Council on American-Islamic Relations, the Muslim Public Affairs Council, and Muslim Advocates.

Muslim Democrats welcome Alikhan’s appointment

At a banquet/fundraiser for the Islamic Shura Council of Southern California last weekend, the first speaker was Arif Alikhan (Deputy Mayor of Los Angeles – in charge of public safety for the city). He bid farewell, as he is going to take a post asAssistant Secretary at the Department of Homeland Security. Arif Alikhan is a devout Sunni and the son of Pakistani immigrants (here).

….speakers included Arif Ali Khan, the former Deputy Mayor of Los Angeles. He bid the attendees farewell as he prepared to leave the Los Angeles area for Washington, D. C. There he will serve as Assistant Secretary of the Department of Homeland Security (DHS).

Professor Agha Saeed of the American Muslim Task Force (AMT) spoke of the aftermath of 9/11 and the struggle of the Muslim Community against the pervasive atmosphere of Islamophobia and hatred. It was a struggle against the tide – a very strong tide – to prevent Muslims in America from being marginalized and silenced.

Professor Saeed ….issued five demands from Muslims to the Department of Justice. These demands included a cessation to the infiltration by spies of mosques and an end to the introduction of agents provocateur. In addition there was to be a cessation of attempts to undermine Muslim groups such as the Council on American Islamic Relations (CAIR).

Why Alikhan? DHS Secretary Janet Napolitano noted Alikhan’s “broad and impressive array of experience in national security, emergency preparedness and counterterrorism.” I am not sure what she is talking about (neither is she, I am sure.)

Arif Alikhan was appointed Deputy Mayor of LA - picked from relative obscurity.

He began his career seven years ago, when he took a job with the Department of Justice hunting down computer hackers, crooks who were selling merchandise on Ebay at rock-bottom prices. In his former position as an assistant US attorney, Alikhan consistently did his work accurately and silently, never producing any headlines. But then he suddenly became one of the most important men in Los Angeles, America’s second-largest city after New York.

He took the position of Deputy Mayor in November 2006. The year that the Congress went Democrat and history and America took a disastrous turn. How does an obscure bureaucrat and a devout Muslim come to the position of Deputy Mayor of Los Angeles – in charge of public safety for the city? And now Assistant Secretary to DHS?

CAIR loses round in attempt to quash book exposing its ties to jihad

A federal judge ruled against the Council on American-Islamic Relations today in its lawsuit against a father and son who carried out a six-month undercover investigation of the D.C.-based Muslim group, denying a request to conduct discovery - an examination of its opponent's witnesses, facts and documents - prior to hearing a motion to dismiss the case.

CAIR is suing P. David Gaubatz and his son, Chris Gaubatz, for allegedly stealing sensitive internal documents and making recordings of officials without consent.

Chris Gaubatz, who posed as a Muslim in an internship with CAIR's national office in Washington, took some 12,000 pages of documents destined for a shredder in an attempt, he said, to expose the group's ties to Islamic jihad and terrorism. His father is a former Air Force special agent with extensive Middle East experience who researches the spread of radical Islam in the U.S. and its threat to national security.

In her ruling today, Judge Colleen Kollar-Kotelly of the U.S. District Court in Washington, D.C., canceled a court hearing scheduled for Tuesday and gave CAIR until Jan. 15 to reply to the Gaubatz's motion to dismiss the case.

The motion filed last month by Gaubatz lawyer Daniel Horowitz asserts CAIR has no claim because it does not legally exist.

Horowitz explains that just two weeks after CAIR was named by the Justice Department in May 2007 as an unindicted co-conspirator in the largest terrorist finance case in U.S. history, the organization changed its name to the Council on American-Islamic Relations Action Network.

"CAIR is not a valid entity and even if it were, the exposure of its inner workings is part of the price it pays for being a controversial group in a hotly contested arena," Horowitz declares in his reply to CAIR's lawsuit.

The FBI produced evidence at the trial of the Texas-based Holy Land Foundation in 2008 that CAIR was established as a front for the Palestinian terrorist group Hamas.

The material obtained by the Gaubatzes is featured in the book "Muslim Mafia: Inside the Secret Underworld That's Conspiring to Islamize America," published by WND Books, an affiliate of WorldNetDaily.com.

The book asserts CAIR is acting as a front for a conspiracy of the Muslim Brotherhood - the parent of al-Qaida and Hamas - to infiltrate the U.S. and help pave the way for Saudi-style Islamic law to rule the nation.

Horowitz said CAIR had hoped to draw WND Books into the legal battle so it could pull the book off the shelves. But the federal judge's ruling today prevents the group from any legal investigation of the Gabautzes or WND Books under the court's authority before the motion to dismiss the case is heard....

M. Zuhdi Jasser: It's time to root out political Islam

For almost a decade, American Muslims have seen a growing debate in their communities about the radicalization of Muslims in America and how to combat it.

Since its inception in 2003, the American Islamic Forum for Democracy (AIFD) has been one of the lone voices publicly waging a contest of ideas with Islamist organizations in the U.S.

The crux of our mission is that the ideology of political Islam (Islamism) is the root cause of extremism that threatens Americans' security as well as the faith of American Muslims.

Most major American-Muslim organizations hatched from the Muslim Brotherhood are advocates of political Islam and will always refuse to acknowledge the need to separate mosque and state.

The recent Christmas Day airliner attack, the earlier December arrests of American Muslims in Pakistan, and the Fort Hood massacre moved that debate into a new phase. The Council on American Islamic Relations (CAIR), the Muslim Public Affairs Council (MPAC) and the Muslim American Society (MAS) have begun to acknowledge for the first time that Muslim communities are facing a "radicalization" problem.

These organizations recently announced they are pursuing "anti-radicalization" programs. This is certainly an important change in their rhetoric, but sadly, window-dressing.

These Islamist groups have simply recognized that their post-9/11 apologetic messaging is not resonating with the general public. To solve the problem, they co-opted the rhetoric of curbing radicalization. But absent real, honest reform against political Islam, their rhetoric is vacuous.

The question that begs to be asked of any Muslim group touting these programs is: What will be the structure and substance of your campaign, and will you confront, renounce and reform the ideology of political Islam?

CAIR and MPAC have typically renounced the use of terror and violence, but they have never taken a position against the ideology of political Islam. They have also been constant antagonists to efforts by law enforcement to understand and mitigate the real stages of radicalization of Muslims in America. Just recently these groups called for government to naively "decouple religion from terror."

If the root cause of Muslim radicalization is Islamism, what good is any counterterrorism effort that decouples religion from terror?

How can law enforcement effectively counter terrorism in our country without recognizing the slippery slope of political Islam and its separatist narrative is the core ideology that drives the mindset of the extremists as they radicalize?

Pragmatically, and I say this with tough love for my co-religionists, many American Muslims need a 12-step program to recognize the driving separatism of political Islam.

So many American Muslims have gone down that slippery slope of political Islam to radicalization that the connection cannot be denied.

Until the majority of American Muslims can reform their theo-political ideas against the growing global power of the Islamist movement, home-grown terror will only increase as it has. There must be a public war of ideas within the Islamic consciousness promoting liberty over Islamism, freedom over theocracy and secular law over Sharia law.

Massachusetts college alters policy banning face coverings

A Massachusetts college has modified a controversial security policy after criticism it infringed on the religious rights of students, a school official said Friday.

The policy originally banned any head covering that obscured the student's face while engaged in student activities.

The Massachusetts College of Pharmacy and Health Sciences e-mailed students about the initial changes this week, saying, "Any head covering that obscures a student's face may not be worn, either on campus or at clinical sites, except when required for medical reasons."

School officials said the policy was intended to ensure that all students would be identifiable "for reasons of safety and security."

But on Thursday, the policy was changed to include an exception "for medical and/or religious reasons."

The original policy had prompted questions and concerns among Muslim students and organizations, particularly because it meant Muslim women at the college could no longer wear the niqab, or face veil.

The college -- with campuses in Boston and Worcester, Massachusetts, as well as Manchester, New Hampshire -- stated that the initial modification was "based on a constructive dialogue with our extended community, and an intensive review of safety and security measures with advisors."

College spokesman Michael Ratty said, "We will achieve our objective of campus security while allowing for a medical and/or religious accommodation. As always, our primary concern is the security and safety of all our students, faculty and staff."

Ratty stressed that Muslims were involved in the original policy decision saying, "Prior to implementation, the college discussed it with several officials within the Muslim community."

Muslim students had mixed reactions to the original ban.

Aisha Bajwa, president of the Muslim Students Association at the college, called the unmodified policy "unjustified and unconstitutional."

Bajwa, who does not wear the niqab, said that having to wear student IDs at all times keeps students safe.

Ibrahim Hooper, communications director for the Council on American-Islamic Relations, thinks the policy targeted Muslim students and filed a third-party complaint with the Equal Employment Opportunity Commission.

Writing to the commission, the Council invoked Title VII of the Civil Rights Act of 1964, which prohibits employers from discriminating based on religion.

Hooper acknowledged that the college's policy focuses on students but said it will inevitably target Muslim employees in the future.

After the complaint, George Humphrey, the vice president for College Relations, e-mailed Hooper, announcing the new policy.

"We have reviewed our ID policy and made an accommodation for religious reasons," the e-mail said. "Thank you for your input on this matter."

Hooper then stated, "We are pleased that the religious rights of all students and staff will now be protected. This is a victory for religious freedom and tolerance."

Ratty said, "The complaint was not the sole reason for the reversal but rather an ongoing discussion this week with our community."

Daniel Pipes, director of the Middle East Forum, supported the original policy.

Though Pipes acknowledged the larger cultural debate, he said the college is focusing on security.

"I have documented dozens and dozens of cases about criminality and terrorism that have been abetted by burqas and niqabs," he said. "It is sensible to ban these, and there are a number of these bans in institutions such as banks or jewelry stores."

With increasing concern about terrorist attacks, religious practices will have to be weighed against security, Pipes said.

"In Turkey, the hijab has been banned from government offices, so this is not something that is just an American concern," he added.

CAIR attorney for apostate girl Rifqa Bary's Muslim parents commits perjury

Omar Tarazi is the CAIR-appointed attorney for the parents of America's most renowned ex-Muslim, Rifqa Bary.

He is doing all he can to get Rifqa back into the clutches of her father, whom Rifqa says threatened to kill her for converting to Christianity.

Tarazi has repeatedly said that he has nothing to do with the Islamic supremacist, jihadist Noor Mosque, of which Rifqa's parents are members. But -- surprise! -- he is lying, and has even perjured himself.

The reason why this is germane is because it is being reported that Omar Tarazi perjured himself in recent court motions, when he denied connections to CAIR and to the Ohio terror mosque responsible for spying on Rifqa and revealing her conversion to her parents with the ominous threat to "straighten her out".

Further, during Rifqa's last hearing, Jamal Jivanjee told me that CAIR-Columbus executive director Babak Darvish was there.

Darvish is the same CAIR rep who was coaching the Barys when they met with the press. Omar Tarazi was going out into the lobby and colluding with the CAIR representative SEVERAL times before and after the hearing....

Hamas-linked CAIR whines about airport search of woman in hijab

Hmmm, let's see. An unindicted co-conspirator in a Hamas terror funding case is complaining about a Muslim being subjected to a security search at an airport.

Obviously CAIR would be happy if it succeeds in intimidating the TSA into relaxing searches of Muslims.

And by sheer coincidence, the people today who are most intent on sneaking explosives onto airplanes and blowing them up are Muslims. So if CAIR gets its way here, everyone who flies an airplane will be at greater risk.

And yet the mainstream media continues to portray this thuggish, dishonest, pro-jihad organization as a neutral American civil rights group -- as you can see right in the lead sentence of this Detroit News article. Detroit -- A national Muslim civil rights group is asking the Transportation Security Administration for clarification on whether Muslim women wearing Islamic head scarves, or hijabs, will be singled out for additional security checks after a traveler said she was targeted for a "humiliating" full-body search at an airport Tuesday.

The Council on American-Islamic Relations office in Washington, D.C., sent the letter via e-mail Wednesday after a Muslim woman Tuesday from Washington's Dulles International Airport to Los Angeles said she was asked to remove her hijab and then put through a full-body pat-down search when she refused to take off the scarf.

She said she did consent to a search. The woman told CAIR officials her clothes, luggage, laptop computer and cell phone were searched and tested for bomb-making materials.

Nadia Hassan, 40, of Maryland said she was patted down in front of her daughter, 5, and several male TSA staffers.

"It was very humiliating. It was very uncomfortable," Hassan told The Detroit News via a telephone interview from California. "I didn't say anything. I didn't want to cause any trouble. ... I'm an American. I'm not a foreigner. My country is treating me this way?"

John Walker Lindh is an American. Adam Gadahn is an American. Anwar al-Awlaki was born in New Mexico. With American Muslims waging jihad warfare against the United States, what exactly does Hassan expect the TSA to do?

Hassan, a Dearborn native, said she was told by one of the TSA guards that "I was singled out because I was wearing the hijab" and that the search was part of new rules that went into effect Tuesday. A spokeswoman for the Department of Homeland Security, which oversees the TSA, did not comment on the incident but said TSA screeners do not single out Muslim women wearing head scarves.

"The Transportation Security Administration's current procedures for the screening of bulky clothing or headwear -- which have been in effect since 2007 -- remain unchanged.

The wearing of a hijab itself does not automatically trigger security checks," said Sarah Horowitz in a written statement to The News. "To ensure the highest level of security, passengers wearing loose fitting or bulky clothing -- including headwear -- may be subject to additional screening."

CAIR National Director Nihad Awad wrote to TSA Acting Director Gale D. Rossides on Wednesday, saying, "If this troubling new policy is indeed in effect, it represents religious profiling in its most egregious form. We respectfully request that you clarify whether Islamic head scarves will now trigger automatic secondary screening for Muslim travelers.

"If so, does this new policy apply to all those who wear religious head coverings, such as Sikh men, Catholic nuns and Orthodox Jewish women, or will it apply exclusively to Muslim travelers?"

Tell you what, Awad: as soon as a Sikh man, a Catholic nun or an Orthodox Jewish woman blows up an airplane, get back to me on this.

U.S. Requests Pat-Downs on All Flights From 14 Nations

American authorities announced that as of Monday, anyone traveling from or through nations regarded as state sponsors of terrorism — as well as "other countries of interest" — will be required to go through enhanced screening techniques before boarding flights.

The Transportation Security Administration said those heightened security measures would include full-body pat-downs, carryon bag searches, full-body scanning and explosive detection technology.

The U.S. State Department lists Cuba, Iran, Sudan and Syria as state sponsors of terrorism. The other countries whose passengers will face enhanced screening include Afghanistan, Algeria, Iraq, Lebanon, Libya, Nigeria, Pakistan, Saudi Arabia, Somalia and Yemen.

The new measures followed the arrest of a Nigerian man, Umar Farouk Abdulmutallab, who allegedly tried to set off an explosive device on a flight from Amsterdam to Detroit on Christmas Day.

Germany announced increased security at all airports following the failed Christmas Day attack, but authorities on Monday said no further measures have been taken since.

U.S. officials in Washington said the new security measures would be implemented Monday but there were few visible changes on the ground in Europe, which has thousands of passengers on hundreds of daily flights to the United States.

Large hubs such as London, Paris, Amsterdam and Frankfurt alone account for 20-30 trans-Atlantic flights a day each.

In Britain, a major international transport hub, a spokesman for the Department of Transportation said he was still trying to decipher the practical implications for Britain of the new U.S. rules. He refused to give his name due to the sensitivity of the subject.

In Switzerland, authorities were studying the new U.S. security measures, but so far the old controls were still in place, said Jean-Claude Donzel, spokesman for Swiss International Air Lines.

And a security official in Spain, who spoke on condition on anonymity in line with agency rules, said U.S.-bound passengers from countries on the new watch list were not being singled out for body frisks.

Muslim advocacy groups bristled at the new TSA rules and urged the agency to consider alternatives. “It comes pretty close to across-the-board profiling of Muslim travelers,” said Ibrahim Hooper, communications director for the Council on American-Islamic relations, adding that it would unfairly single out not just foreigners but Muslim Americans traveling to see their families in the selected countries. “It only serves to alienate those whose hearts and minds we’re trying to win.”

Alejandro Beutel, government liaison for the Muslim Public Affairs Council, said the ruling would cast such a wide net as to ultimately be ineffective.

“We do see this as profiling, and profiling is very poor policing,” he said.

Elsewhere in the world, there has been a general ramping up of security since Christmas.

In Jordan, a key U.S. ally, security was beefed up at Amman's main international airport since the Christmas Day bombing attempt. An official at Queen Alia International Airport said "enhanced techniques" were being applied, especially in screening passengers bound for the United States. He declined to elaborate.

Pakistan's national airline said it was intensifying security checks for U.S.-bound passengers, even though there are no direct flights to the States from Pakistan. Screening was also stepped up for those flying to the U.S. from other parts of Asia and the Middle East.

"It is beyond my imagination what more they could do," said Nadim Umer, 40, a Karachi-based linen merchant who said he was subjected to a strip search when he arrived in New York last June. "Those who are dying to go to America at any cost can put up with all this inhuman behavior, but I cannot."

A spokesman for Pakistan International Airlines said the company began applying the new security standards Jan. 1 on U.S.-bound passengers.

Sultan Hasan said the passengers are subjected to special screening, including full body searches, in a designated area of the departure lounge. He said the airline had run advertisements in newspapers to warn prospective passengers of the increased safety measures. maintaining strict security standards at all airports for all flights.

"We are already carrying out all possible security arrangements at our airports which can be compared with any Western airport," Pervez George, spokesman for Pakistan's Civil Aviation Authority. "Safety of the airliners and passengers as well as security at the airports is a top priority and we are maintaining it irrespective where the flight is going."

In South Korea, an official at Seoul's Incheon International Airport, Lee Ji-hye, said U.S.-bound passengers are now required to go through additional security before boarding their flights, and security officials also compile lists of "suspicious" passengers to monitor based on their nationalities, travel patterns and ticket purchases.

Australian Transport Ministry spokeswoman Moksha Watts said all passengers flying to the U.S. would continue to be patted down and have all their cabin luggage searched.

Baghdad's International Airport already has extremely tight security, with passengers having their luggage sniffed by dogs and getting patted down before entering the airport.

"Our security procedures at the airport are more intensified than that in any other airport in the world," said security official Umran Idris.

Maayan Malkin, spokeswoman for Israel Airports Authority, declined to discuss security arrangements. The Ben-Gurion International airport is considered one of the safest in the world.

CAIR: Fort Hood Co-Conspirator – by Paul Sperry

With the FBI cutting off ties to the Council on American-Islamic Relations and now subpoenaing some 12,000 internal CAIR documents under temporary restraining order as part of the bureau’s ongoing criminal investigation of CAIR, the terrorist front group is suddenly cooperating with the FBI — or at least making a show of it.

Suddenly CAIR, an unindicted terrorist co-conspirator, is acting like a good citizen.

Suddenly it’s concerned about young Muslim-American men going on jihad. Suddenly it’s concerned about “certain” passages of the Quran inspiring jihadists.

It’s all too little, too late.

Thanks to CAIR, 42 brave American soldiers were gunned down by an Islamic nut in Texas. That’s right, thanks to CAIR.

How so? For starters, it was the intimidating and ruthless CAIR that almost single-handedly created a climate of fear of reporting any suspicious anti-American behavior on the part of Muslim soldiers like Army Maj. Nidal Malik Hasan, accused of the worst terrorist attack on U.S. soil since 9/11.

The CAIR-induced mass silence led to mass murder.

Fear in the military of being seen as anti-Muslim also blocked intellectually honest discussion of violent Islamic ideology in the ranks.

Thanks to CAIR, the military along with everyone else in government is terrified of associating terrorism with Islam. No one dares utter the M word, lest they be sued for discrimination or branded an “anti-Muslim bigot” or “Islamophobe” by CAIR’s smear merchants.

“There were definitely clear indications that Hasan’s loyalties were not with America,” said Lt. Col. Val Finnell, one of the Army doctors who served with Hasan. But nobody said anything because “there’s a political correctness climate in the military,” and everybody’s “afraid of an equal opportunity lawsuit.”

CAIR’s lawyers have filed thousands of EEOC complaints and lawsuits since 9/11. They’ve even gone after John Doe citizens who alerted airline crew to Muslim men behaving as menacingly and suspiciously as the 9/11 hijackers. CAIR’s “Flying While Muslim” anti-profiling campaign has had a chilling effect throughout the aviation security industry.

CAIR gulled non-Muslims into the kind of see-no-evil dhimmitude that allowed Hasan to carry out his alleged terror. Had anyone dared officially protest Hasan’s extremist views, they would have not only risked their military careers but potentially faced a lawsuit sponsored by CAIR.

Hasan was treated with kid gloves because CAIR demanded it.

Thanks to CAIR, a dozen soldiers lay dead, along with 29 wounded, some so severely they’ll never be deployed in the war on terror again, which is just fine by CAIR.

Since 9/11, the Saudi-funded front group has consistently and vehemently protested the war, even in Afghanistan, while defending the Taliban and other terrorists.

Muslim group asks Obama for protection

WND investigation seen as example of 'alarming level of anti-Islam hate'

Citing the impact of the WND Books expose "Muslim Mafia" as an example of rampant "anti-Islam hate in our nation," the Council on American-Islamic Relations called on President Obama yesterday to address what it calls an "alarming" problem.

CAIR – which has filed suit against "Muslim Mafia" co-author P. David Gaubatz and his son for an undercover investigation of the group's terrorist ties – distributed a list of "anti-Islam incidents" that included "a call by far-right members of the U.S. House of Representatives to investigate Muslim interns on Capitol Hill as 'spies.'"

"President Obama is in the best position to address the alarming level of anti-Islam hate in our nation and to urge religious and political leaders to speak out in support of tolerance and mutual understanding," said CAIR National Executive Director Nihad Awad.

As WND reported, Reps. Sue Myrick, R-N.C., John Shadegg, R-Ariz., Trent Franks, R-Ariz., Paul Broun, R-Ga., formally asked the House sergeant at arms in October to investigate evidence from "Muslim Mafia" that CAIR is conspiring to plant "spies" inside Congress targeting sensitive security-related committees. In another letter, to Attorney General Eric Holder, the House members ask the Justice Department to reveal to Congress members why CAIR was listed as an unindicted co-conspirator in the largest terror-finance case in U.S. history.

Last month, the four lawmakers were joined by Rep. Patrick McHenry, R-N.C., and Sen. Tom Coburn, R-Okla., in a letter urging the Internal Revenue Service to investigate CAIR to determine whether the Muslim group's lobbying activities on Capitol Hill violate its nonprofit status.

"Muslim Mafia" uncovered confidential CAIR memos revealing that in one year alone, CAIR officials made 72 separate trips to Congress to lobby against the Patriot Act. The same year Congress met fewer than 150 days.

U.S. prosecutors believe CAIR, while claiming to be a civil-rights group, is actually a front group for Hamas and other terrorists. The Justice Department stated in September 2007 during its prosecution of the Holy Land Foundation in Dallas that CAIR "has been identified by the government at trial as a participant in an ongoing and ultimately unlawful conspiracy to support a designated terrorist organization, a conspiracy from which CAIR never withdrew."

CAIR said its annual national report on the status of American Muslim civil rights, released this month, showed an increase in bias-related incidents in 2008.

CAIR has claimed since the 9/11 terrorist attacks that Muslims in the U.S. have suffered a sharp rise in anti-Islamic abuse.

The group's 2005 abuse report, blamed a purported increase in anti-Muslim harassment, violence and discriminatory treatment on the Internet and talk radio.

But FBI data actually has shown the number of incidents is dramatically shrinking.

The 2006 total of 156, for example, was a 68 percent drop from 2001.

Moreover, incidents against Muslims were just a fraction of overall hate crimes. In 2006, 66 percent of religiously motivated attacks targeted Jews, while just 11 percent were against Muslims, even though the Jewish and Muslim populations are similar in size.

In its letter to Obama, CAIR cited recent incidents in Florida in which a cross with the message "Christian nation, Christian community" was planted at the site of a planned mosque and an anti-Islam Christmas display was set up by a local church.

Other incidents listed were "a spate of vandalism incidents at mosques nationwide" and "anti-Islam remarks by Christian evangelist Franklin Graham."

CAIR's director Awad said Obama himself has been "targeted by anti-Muslim hate despite the fact that he is Christian," noting a Colorado car dealer recently put up a billboard depicting the president as a "turban-wearing militant."

Awad pointed to recent remarks made to a Muslim and Arab-American gathering in Michigan by U.S. Attorney General Eric Holder in which he said the Justice Department will return to its "traditional" role of ensuring civil rights. The president has signed a spending measure that will give the Justice Department's civil rights division 102 new staff members, many of whom will be assigned to hate-crimes investigations.

CAIR said it began airing a new public service announcement called "I am Muslim, I am American" yesterday on the CBS Super Screen in New York City's Times Square.

FBI steps in

CAIR's suit against the Gaubatzes claims they stole sensitive material from the group's Washington office under false pretenses. But lawyers for the defendants filed a motion to dismiss the case this week that contends CAIR has no claim because it does not legally exist.

A federal judge in Washington issued a restraining order Nov. 3 barring the Gaubtazes from further use or publication of the material – 12,000 pages of documents along with audio and video recordings – and demanding that they return it to the Muslim group's lawyers. But the FBI stepped into the case Nov. 23 with a warrant to examine the papers and recordings, apparently as part of its concern about CAIR and its terrorist links to Hamas. The bureau cut off ties to CAIR after the Islamic group was named an unindicted terror co-conspirator in the Holy Land Foundation case.

"Muslim Mafia," by David Gaubatz and "Infiltration" author Paul Sperry, asserts CAIR is acting as a front for a conspiracy of the Muslim Brotherhood – the parent of al-Qaida and Hamas – to infiltrate the U.S. and help pave the way for Saudi-style Islamic law to rule the nation.
